located on the Moulfcello Mountain, near
Cliarlotievill*, All ermarle county, 's in
litigation at present, before .the Supreme
Court of Virginia It in well known that
Mr. J. floraon expended a lavish fioepi
talily and died poor. Monticello, hie
i stale, was aold and pmolmeed by Com
modore Levy, of liar United States Na
vy, Com Levy deviaed (lie '‘state at
hit death to the United States as trus
trea, for the purpose of establishing an
agricultural farm on which to educate
to agricultural pursuits children of the
warrant ofliceia of the navy, whore fa
thers were dead. In aid ot this scheme
lie also devised $300,000 worth cf proper
tyjin New York. In the event of tlie Uni
ted States not accepting the trust, lie
provided that the State of Virginia should
act as the trustee for the purpose named,
ami in the event of Virginia not accept
ing the trust, lie devised the property to
the Portugese Hebrew congregation ol
New York, Philadelphia and Baltimore,
for the benefit of ttie children of these
societiis whose fathers were dead. Ilis
legal heirs brought suit in New York to
set aside these provisions of the will.
The court ia Now York declared the
charity too indefinite, and that llnr Uni
ted States could not take the property
as trustee. Virginia, not being a party
lo rho anil, instituted a suit lor its re
covery ns secondary trustee. The case
is at present being exhaustively argued
in the Supreme Court of Virginia, now

since, at a late hour, the speaking tube
at the office door of a popular physician
