Call and ex amine! GILMORE. &'Co-i Sept. 21,1870 tf The Georgia Election Law. An Act to Provide lor an Election, and to Alter and Amend the Laws in Relation to the Holding ol Elections. Section I. The General Assembly of Georgia here by enacts, That an election shall beheld in this State, beginning, on the 2llth day of December, 1*70, and ending on the 22d of said month of December, 1870, for members of Congress to serve during the uuex pired term of the Forty-first Congress of tho United States, and for membeis ot tits Forty-second Con gress ; for Senators in the State Senate from each ustrict numbered in the Constitution with an odd lumber : for members of the House of lleprosonta tivesof tho General Assembly; for Sheriffs, Clerks of ha Sup. rior Court, Tax Receivers and Tax Collec tors, County Treasurers, Coroners, and County Sur veyors, of tho several counties of this State. Skc. 2. That the said election shall commence on th: said 2tdhday of December, and continue b-. tween the hourB now fixed by law, for threo separate days. Sec. 3. That said election shall he managed and superintended at the several court houses at the coun ty scat, and at any election precinct that may exist or be established in any incorporated and organised city or town, by managers chosen as follows: Sec. 4. And it shall be the duty of tho Governor of the State, by and with tho advice and consent of the Senate, a* soon after the passage of this act as possible, to appoint three, and the Ordinary ot each county two, fit and proper persons, of intelligence and moral worth, for each election precinct establish ed at the county court House, or in any city or in corporated town in this State; and said five persons, or any three or more of them may and shall hold thi election at said court house and precincts in such city or town. Sec. 5. It shall be tho duty of the Governor to 0 iusc the said appointees to he duly notified of thei several appointments as aforesaid; and it shall he tin doty of said appointees to appear at the said court houso, and at said precincts in said city or town, or he days fixed by this Act, for the said election, with in the hoars heretofore prescribed by law, and hole sail elections- Sec. fi.lt shall be the duty of the Governor to fur nish each of the judges of the Superior Courts witl. a list of said appointees in the several counties o: the respective circuits, and at the next term of said courts in each County, after the said electoin, it shall be the duty of the judge to inform himself if said apnointecs have appeared as required hv this Act and held the said election, and it any such appoin tees have tailod to appear, aud tho absence of hi: signature to the returns required by law to be made ti he Clerk of ss:d court, shall bo prtma facie evidence o: such failure, it shall be tho duty of said judge fo th with to “fine any such appointee one hundred dollars Provided, That said fine may be remitted on said ap pointec satisfying said judge that his failure so t. attend was caused by severe sickness or other una voidable cause, or that he was legally disqualified from serving- And providod further..,'. In addition to tRe duties now prescribed by law for the managers of elections, it shall be the duty of said managers to preserve order at and near th. polls, but they shall have no power to refuse ballots of any male person of apparent full age, a resident of the county, who has not previously voted at th. said election- Sec. 8. They shall not do permitted to chaliang- any v te, or hinder, or d day, or interfere with any other person in the free and speedy casting of his ballot. Sec. 9. It Ehall bo the duty of said managers to prevent all rioting, disturbances, and crowding at or near the polls, and, to secure this end, it shall hi their duty to prevent more than one person, and he only while voting, approaching or remaining within fifteen feet oj the place of receiving ballots : and thi said managers may, if they see fit, require that per sons dosring to vote shall form themselves into a line, anc when a line is thus formed, said manageis shall prevent asy porson not in the line from ap proaching the polling place nearer than fifty feet, bu rn no case shall more than one voter at any time be permitted to approach the polls nearer than fifteen feet. Sec. 12. It shall be the duty of said managers to receive each ballot and drposit-the same in a ballot box and it shall not be lawful for either of them, or .for any Clerk to open any -closed ballot until the polls are oi03ed,and the cc.unting of.the voter is cemmenoed. -V Sro. 'Oit for this act, a ballot b> x sufficiently large to hold the ballots likely to be Hist at said polling place—said ballot box to be made so that it cannotbe open ed without serious damage to the hex on all sides except on., and on that side to have a tnovab.e lid with the opening therein sufficient ly large to admit the pushing in of t ie ballots one by one said lid to be vo constructed as that it may slide into grooves in the box, nudyhave a lock thereon ; and it sha l be the duty of the. managers to open and examine said box at the opening of the polls, and then to look the sane j and at the close of tne polls on each day it shall he the duty of each manager to put upon said lid a strip of paper with his name there on, and affix the seme by adhesion to the lid and box so that the box cannot be opened with out the rupture of said paper; and this being done, the box shall, lor the night, be entrusted to the keeping of one of the managers, and another of tho managers shall sake the kt-y; and it shall be the duty of such managers en trusted with s .id fox or key. to permit no one to tamper in any way with the same; and if such tampering he done, the manager entrus ted with the same, shall be deemed pritna facie guilty of having-dime the same, and on con viction, sits ll be punished as provided in sec tion 4608 of the Revised Code, for" the punish ment of misdemeanors. . »f.c. 22.
