Commissioners Court.
Court opened iu due form by Marshal Har
baum. Colonel Lofton stated that not hating
seen Constable E. P. Smith, had not written
out an answer to the charge of contempt of
Court. The Court granted a recess until 8
o’clock for the hearing of that case. Mayor
Huff was put upon the witness stand and con
tinued his testimony:
These are the eight men I had as regular po
lice: James Martin, 11. C. Taylor, John Hur
ley, B. Lowenthal, Charles Craig, James Burns,
Pat Murphy, John Alley, Henry Gartield, Chas.
Wood and Thomas Battle. The extra police
were G. Hoisenbake, Jesse Simpson, J. Bull,
W. J. Darraugli, Wm. Thomas, John Costello,
Richard Green, 11. Martin, Wm. Chapman, A.
S. Moore, J. W, Moore, A. Hightower, It. C.
Fennel, 1). Fennel, J. B. Sessions, Robert Ses
sions, James West, John Breek, Nathan Duke,
C. J. Owens, George Ran, L. Lowenthal,
William Wryc, T. Furlong, John Hawkins,
M. Kavanaugh, Richard Alley, and \Y illiam
Steepler iu command. I called out an extra
special police. The charter of the city
gives me that authority. 1 conferred with
Captain Jones, as several parties came to me
to be sworn in as extra special police. I asked
Captain Jones to take command. He at first
refused, but afterwards consented, as he
thought as I did about the matter. Ho said
there might be trouble and it was well enough
to be prepared for it. There are more compa
nies in the city besides that of Captain Jones’.
There are the Floyd Ritles. Think Major Ross
is Captain. [Witness was informed that Col.
Hardeman was the commander ] Did not call
the aid of all the other companies. Captain
Jones was to select fifty or sixty men Don’t
remember the exact number. I gave the order
to select the men, about four o’clock the oven
ing previous to the election. The men were
to report at 8 o’clock that evening at the En
gine house of No. X. 1 was there at that hour.
Capt. Jones took the chair and stated that the
object of meeting was to organize and prevent
as fur ns possible any disturbance on the day
of election; that he would take command and
receive instructions from me, and through him
to the police. The following is a list of those

until they received instructions from me
through Captain Jones, except in case of emer
gency. They were to look to Captain Jones
for orders and he to me. This is the oath:
You and each of you [here Mr. Rutherford
asked what relevancy this investigation was to
the trial of Mr. Ellis. Court decided the in
vestigation proper], do solemnly swear that
you will, if called upon by me to-morrow, per
form the duty of a police ofllccr of the city of
•Macon to the best of yonr knowledge and be
lief without fear, favor or affection, so help
God ? I gave no further instructions; I
did not furnish them with fire-arms. Captain
Jones said he could probably get the guns from
Hodgkins. Hodgkins had furnished me with
sejnc thirty or forty and I supposed they could
get them there. Hodgkins & Son are gun
smiths and dealers in guns, pistols, etc. Don’t
know whether ho procured arms for them. I
did not store any arms in the vicinity of the
precinct. I retired about half past one that
night. I don’t know anything of a meeting
in a certain engine house that night.
I don’t know anything of a meeting at a certain
gambling house that night in the city. I don’t
known of any signal at any engine house—did
not hear it. Between one and two o’clock the
night previous to the election was when I re
tired X was at the City Hall at 10 or 11 o’clock;
walked from thereto Boardinan’s corner, then
back to City Hall; then, after seeing that ail was
quiet, I went home. Ido not know who tore
down the structure. I never heard any one say
they would tear it down —nor that it ought to he
torn down. I have four or iivepistols here f pro
ducing four pistols'!. They are not loaded.
{Laughter.] Messrs. Lowenthaland Dukes cap
tured them. I don't know who they belong to.
The officers probably know. When Dr. Collins
Sr 1 the negro were struggling, I sawa pistol in
the Dr.’s bosom somewhatentangled in his vest.
In endeavoring to get possession of it I hurt
toy thumb, then let go, and saw no more of the
pistol. I don't know what the negro 6aid to
Be at the time. He seemed to apprehend
some danger. Do not remember whether he
called on me for protection. I did not get en
tire control of the pistol. It was a short time
•ft-r that the brick was thrown. [Mr. Huff
here related oceourrcneesand incidents around
the polls in 1870 and explained the mariner of
taking possession of the polls.] I feared
trouble and a repetition of those scenes, and
I heard the white people say that such a thing
as taking possession of the polls by the
negroes should not be doue again, and
it was whispered around town that it
would not be done again. There were
-no allusions to violence. The only
H thing that led me to think my police wa3
j|. objectionable was the conversation I had with
V Col. Whittle. [The conversation was here re
lated.] Don't recollect advising any county
officers to get someone to protect the struc
ture. I told someone that I did not think it
would be there in the morning. I came into
the meeting of citizens called by Judge Ward
when It was nearly over. The Impression
prevailed in the commit co that all the votes
could not be polled at one polling place. The
easiest entrance to the voting place was from
the street. There was nothing to prevent the
negroes from from coming in that entrance. I
did not sec any effort on the part of the
whites to form a hue and hide their
time to vote. There was no effort on the
part of the blacks to forma similar lino.
There was no difficulty about the approach
es I did not see the fence after its con
struction. There was an understanding I
think of the Committee for the w hites to
approach from llie front and the colored
from the rear. The most convenient
inode of approach was from the street.
The defence had but few questions to
ask iti llie cross examination. The hour
for adjournment having arrived, the
Court took a recess until 3 o'clock.

at the hall and would have given a good pi r
foruiuscc to quite a large audience. Every
thing will be in apple-pie order to-night and no
one will be disappointed either in regard to
gas or performance. If you desire to bear
something excellent in the way of music, go
and hear them to-night. Take a lady along
with you.

Wo thought we said a good deal about the
Isaacs House, hut here comes the Masons and
pile on a certificate of excellence so high that
our humble recommendation is crushed be
neath its power. We give under-gracefully,
for we know thav are better judges of good fare
and comfortable quarters than we arc.

In consequence of a delay in the special train,
the Circus of James Robinson gave no per
formance this afternoon. By to-night every
thing will be in order, and the first appearance
will take place at the usual hour.
’i’lio Dawsun Kair.
A dispatch from Dawson, yesterday, an
nounces that Mr. Clay’s horse, Gray Eagle,
won the. race. Mr. C. also says he had taken
all the premiums offered for which lie con
tested.
The Bibb Superior Court lias been adjourned
to next Wednesday morning as an act of
courtesy to the United States Commissioner’s
Court.

The Savannah News of yesterday sajs :
This evening Mrs. It. P. Bowers, llie
eminent tragedienne, commences an en
gagement at our Theatre in the tragedy of
“Lady Audlcy’s Secret,” Mrs. Bowers sus
taining the cliaraater of Lady Audley. In
this personation she is said to be without
a peer, and her talents are peculiarly ad
apted to the requirements of that striking
character.
There are few, if any, ladies left to the
American stage who can vie with Mrs.
Dowers in the characterization of these
parts which require impassioned expres
sion. She has a full and deep nature,
which responds to all the demands of the
tragic muse and expresses itself in the ut
most tenderness or the bitterest denuncia
tion as occasion may require. We have
seen her full of gentleness and love in the
character of the mad Ophelia or Juliet or
Desdemona, and equally full of unswerv
ing purpose in that of Lady Macbeth.
Her elocution is of the highest order,based
upon the best models when Macready
and Charlotte Cushman were the teachers
of the stage, yet not narrowed by its tra
ditions so far as to prevent that natural
expression which the more literal spirit
of the age requires.
All who love to hear llie English lan
guage well uttered, with proper emphasis
and gesticulation, and admire the expres
sion of heroic sentiment, in dramatic ac
tion cannot fail to be pleased with Mrs.
Bowers’ representations She is a graceful
mover, and her attitudes singularly ex
pressive, and Avitlial she has admirable
taste in dressing the part she represents,
the influence of llie classic age of our dra
ma being everywhere apparent. Under
her acting the theatre is a school in which
she is an excellent teacher.
