Mr. S. H. Smith, from Pataka, 111., died in
i his city at the Isaacs House, yesterday evening
about 0 o’clock. It is supposed lie died of ap

.Stolen Hides.
For some times past our citizens have been
missing their cows and yearlings. Every pic
caution was taken to ferret out the cause of
their disappearance, but all to no avail. Col
..Rutherford lost a couple of fine heifers the
. biker day, and instructed the hide dealers to
Ikucp a look out for his hide, giving them a de
scription of the missing bovines.
This -morning a couple of negroes called on
tue ijernd Bros, with a hide that tallied with
the description given by Col. Rutherford. The
Bern* Bros, .delayed payment until officer Ilufl
came in and nabbed the two ebony thieves.
They were hauled up before his Honor,
when one of them, Bill Fraley, made a half
way confession. He said lie lived witli Mr.
Herbert Reynolds near Griswoldville, and had
made an arrangement with the other darkey,
John Harris to bringin the hide and share in the
proceeds Harris,however, was obstinats and said
he found the hide. He told a very conflicting
story concerning it, and the court continued
the case until some evidence could bo intro

Four yesterday's Issue contains a report of an
assault made upon till by John B. Cummings,
which docs me Injustice, nnd I therefore crave
a hearing at your hands.
The facts arc: I did charge Cummings with
defalcation, while an officer of the city. For
this, it appears, lie waited upon the street
which I usually traverse, nearly or unite an
hour, making no secret of his intention to kill
me when he saw me. When 1 came along, lie
made threatening gestures as if to draw u pistol
on me, and confronted me on the side-walk,
and said : “What did I ever do to you that you
should publish me, you damned lying son-of
i— v” X replied that I would make no resis
tance to his abuse, as 1 was not armed ns lie
seemed to be. He then repeated that i was “a
damned lying son of a-—," and to arm myself,
is lie intended to “settle” with me. “Very
well,” said I, “I will do it,” and immediately
passed on. I went to my room uud returned
io tlie corner of Cherry ami Colton Avenue in
ten or lifteen minutes, where 1 stood, from live
to ten minutes, about fifty yards from where
Cummings was, and in plain view-of him and
liis friends. Seeing him sit down on a bench,
near where lie was standing, I took it for
granted lie. had changed his mind about settling
with me, and so I went about my business.
1 might have advanced up tiie street from
where I was, but that would have made me the
aggressor, a position l do not dare place my
self in because of the present organization of
our Courts. Besides, I was not seeking the
difficulty. I felt bound, ns lie bad permitted
me to go to prepare myself for him, to return
and show him thatl was ready to afford him
satisfaction.
The language used towards me by Cummings
is hi* language, not mine, and 1 am therefore
not responsible for it. If the statement made
uy me, relative to Cummings is a lie. then 1 ad
mit that I am a liar; but in justification of my
statement, I'-call upon the Treasurer of the
city of Macon to say whether I am a liai onr t.

cil, who has a record of the proceedings in
relation to it.
His charge that 1 am a “ on-of-u ”
would convey Ihe idea that he knows some
thing about mv ancestry. I can only say in this
connection that 1 am ready to compare my
lineage with his.
The statement Unit Cunmdugs spit in my face
is untrue, as also,’that 1 ran my hand in my
pocket, us if to draw a weapon. 1 did not go
to the Union office, nor was I gone “about half
an hour.”
In publishing the statement I did in the Union,
I conceive that 1 was only doing my duty as an
impartial journalist. 1 was putting facts before
the people, so that they might know how to
act in their choice of officers to take charge oi
their public affairs. Cummings asked me what
helmd done to me, that 1 should publish him.

sonally, but as a citizen of Macon, lie lias used
my money, and lias failed to account for it.
Knowing" this fact, and being a public journal
ist, it was my plain duty to make my fellow
citizens acquainted with it.
I wish to say, also, that it lias come to my
ears that I was instigated to write the article
in question by certain interested parties. That
1 deny. I have never yet learned the art of
being led about by the nose by place seekers,
as those who know me best, will testify.
