Wasjocb, J.—This was an action brongbt by
the Dlaintiff against the defendant*, on a prom-
imorynote for $2,350 i»3, payable lo Houser ft
Bnmmo, or bearer, dated 1st Joly, 18C8, and
doe one day after dale.
The defendants, W. nouser ft Brunson, plead
the general isane. On the trial of the erne,
it appear* from the evidence of the plaintiff,
wbo was introdaood by the defendant*, ‘hat the
note mod on was placed in the hands of the
plaintiff by Bronson, together with other note*
and aceouota. aa collateral security, to accuse
himasif against losa on a note made bv Ilonaer
ft Bronaon for $2,000, payable to Bryant ft
Wimberly, to which tbo plaintiff was security;
about nine months after tho suit w*s com-
meneed by the plaiotiff against the defendanta.
tbo Bryant ft Wimberly note was pdd off out of
the proceed* of other collateral*, »nd that plain
tiff had no other interest in tbo note than to
aooonnt to nonser ft Bronson for the same or
the prooeed* thereof. The plaintiff in rebnttol
introduced UolUeUw, who teatifiedthat the note
sned on was placed in his hand* as an attorney-
at-law by the plaintiff, and Bronaon, of the firm
of Hooter ft Bronaon, to aeenre the plaintiff
again*! loss aa their security on the Bryant ft
Wimberly note, and it waa agreed between
plaintiff and Houser ft Brunson, that this note,
with other note*, should be oolleeted by him,
and tbo proceeds applied to the payment, first,
of the note on which plaintiff was security, and
the balance to be retnrned to Houser and Brun
son for tho benefit of Uieir creditors, the firm
being insolvent, anil that ho brought snit on
the note in the naino of the plaintiff with that
understanding. W. Houser, of the firm of K.
Houser ft Brunson, ia a different man from the
payee of the note, James M. Houser, of the firm
ofUouaerft Branson, the defendants being a
fanning firm, and the payees of the note a mer
cantile firm. I-pon this evidenoo the court dis
missed tho plaintiff's action. In oar judgment
this waa error. The plaintiff at the time of tho
commencement of his action on tho note bad
the legal title thereto, and was entitled lo re-
oover a judgment thereon against tho defend
ants, tlie proceeds of whieh, when oolleeted, he
would hold as trustee for those who were legally
or equitably entitled to U10 same. Tho conrt
should have submitted the evidence to the jury
and charged Ihcm ns tho taw applicable thoreto.

Waatixa, J.—This was a bill filed by the
oompiainanla against tbo defendants, aa the
S urchaacr of certain specified tracts of land at
heriff'a sale nnder a fi. fa. against the defend
ant, N. F. Walker, praying for an injunction to
restrain them from prosecuting their respective
claim* to a homestead on tho land so purchased
by him at anefa Sheriff'« sale. The bill alleges
that the defendants are fraudulently combining
to obtain homestead* on tho land for tbo bene
fit of N. F. Walkor, ono of the defendants, the
other defendant not being entitled to a home
stead nnder the law, and that tho complainant
not being a craditor of tbo applicants fora
homestead, cannot bo heard in tbo common law
courts to object to the granting of the same.
The lull waa domnrrcd to for want of equity,
and because it was multifarious. Tbo court
■attained the Utter ground of demurrer and
amended the former, both parties exoepted.
Wo think the court erred on liotb grounds.
If there wss equity tn the bill, the chargo
of a fraudulent combination between the
defendanta to obtain n homestead for one of
them would r.ot mako (he bill mnitifariona,
bnt would relievo it from that objection on de
murrer therefor. Althongh the complainant as
a purchaser of tho land at Sheriff's sale ia not a
creditor of the applicants for a homestead on
tho land so purchased, still, ho derives bis title
to tho land nnder the jndgment of a creditor,
and may nrgo the same objections in thu Court
of Ordinary, or in tho Supreme Court, on an
appeal therefrom, aa the creditor could have
done nnder whose jndgment and elocution ho
derives hla title to the land. In other words,
the purchaser of the land nnder a judgment in
favor of a creditor nt Sheriff's sale on which a
homestead ia claimed, is as much within the
reason and apirit of the Act ot 1S«8, aa the
creditor nnder whose judgment he derives bis
UUe, may bo heard and make the same objec
tions to granting tho homestead as the creditor
ooutd hnvo done.
Let the jndgment of the court below be re
versed.
