UM, That the eonrt erred in dismissing the
plea upon this ground. The law of 1870 is not
« post facto, for that applies to criminal and
not civil cases. The requirement that an affi
davit be filed that taxes duo the State thereon
have been paid, docs not render it unoonstito-
Uonal. If no tax waa due, the taw imposes
none, and if tho tax waa due, creditors are not
a favored class to bo exempted from tho pay
ment ot tbeir legal taxes. The Parliamentary
law said to be violated, and, by it the constitu
tional provisions for the passage of laws, does
not operate to render it unconstitutional. Acts
of the Legislature are presumed to be constitu
tional, and court* will notdodsro them void ex
cept in dear and urgent case*. It doesnot impair
the obligation of contracts, for the law does not
alter, modify or chango a word in it; nor doea it
impair the remedy, but both stand nntonched by
the law, and tbe requirement of the payment of
tax due on the contract neither impairs tbe obliga

aented by tbe plea that tbe note sued oo was
given in renewal of an old debt due before Jane
