W. F. Newman, city attorney, by 4. V. "tr-
riaoo, contra.
Warren Aiken vs. jTdTCameron. Complaint
from Fulton. .. . ... .
Ix.cnai.xr, C. J.-Wben, upon “>•
suit at common law upon a note minle before
dune, 18G5, the defendant mored to dUmiw on
orermlrd by the court: . , .
Jlrltl That this waa error, and under the facta
in thia case, Aiken being a tranaferea of the
note, waa not called upon to go farther than
show there waa a complaint with the require-
menu of the Act of 1870, by haring paid tho
legal tax thereon while he held the note, or hare
otherwise shown that no tax waa due. etc.
Judgment rereraed, Warner, J.. diaaenling.
L. J. Glenn A Son, for plaintiff in error.
IliU A Candler, contra.
Jane Frank vs. Longatreot, Sedgewick A Co.
Aaanmpait, from Fulton.
Wnnixr, C. J.-Where the payee of a note
endorse* it after maturity, and suit ia brought
l.y the endoraee against tho maker* and eodoner,
the plea by tbo makers seta up usuiy. and the
judge held auch plea by tbe maker* did not af
fect the liability of tho endorner upon his con
tract of endorsement after maturity of tbo pa-
^J/rW, Tbia waa not error. The contract of
endorsement waa a new and diitinct contract,
not alfeoted by usury between the payee and
maker* in the bauds of tho endorser without
notion, and tbo endorser, in • suit against him
by tbo endorsee, eanuot set up hi* own illegal
act In taking usury to defeat a recovery against
himself as endorser.
JIM again, When a note made to bo nego
tiated at a chartered bank, lint notao negotiated
and held by the payee at its maturity and en-
doraod with a waiver of demand, and noticed
l>y tho security, and after iU maturity endorsed
by the payee, upon such paper, under our law
under ttltttHh section of the Codo such en
dorser after maturity, npon suit by the cn-
dorsco is not discharged by the failure of proof
of “ demand and notice," and it waa not er
ror in the court to refuse a now suit on thia
ground:
Udit again. That in order to render verbal
ovidouco of the contents of the notice required
by our low, to be in writing and to oontain oor.
tain facia, oven when auch notice is out of tho
jurisdiction of tho conrt, it is Amt necessary to
give notico to the party or bis attorney to pro
duce it.
/Ml, again. When tho evidence ahowa that
the maker of a note borrowed $3,400 from tbo
payee, and gave three notes of $1,13(1 each
therefor, and pays two of tbe notes, and tho
inycc endorses the last uoto to a third party,
that in the bands of tho third party, tho note is
only void to tbo smonot of usury thereon, ami
it ia not within tho purview of tbe defenae of
tbo maker to such note, to set up usury paid
npon the other notes to tbe bolder and payee
thereof.
IIM, again, Thai the evidence being that
only $800 was received npon tbe note due at
twelve months for $1,13(1, and $731 83 waa
pali! at maturity, that the difference between
$800 and legal Interest for one year, tbe lawful
principal of tbo note, and the payment ia the
amount duo, with interest, by tbe maker to the
indoiwo, and we hold that tbe vordiet is in ex
cess of tho amount duo under the ovidence, and
ought to have lieen for $134 18, principal with
interest from 13th January, 18(18, and direct
that the verdict conform to this amount, clue a
now trial lie granted to Jano Frank, tbe prin
cipal, and M. Frank, the security.
JIM, again. Under our Code, juries may find
rquitabln verdicts, and that the verdict against
Guild, tbe indorser npon the note aned, stands
'affirmed.
Judgment affirmed with instructions.
M. Arnold, U. J. Cowart, for plaintiff in
error.
Hillyer A lire., contra.
JU .1. lliKliuru, vs. Geo. S. Rlack. KcIiofAct
1870, from Fulton.
fjocnnxNK, U. J.—When tbe conrt below ren
ilered a judgment upon n note made before Juno
1, 18113, after overruling the motion to dismiss
tbe anit for non-compliance with the set of Oc
tober, 1870, in relation to taxes:
JIM, The court committed error.
Judgment reversed, Warner, J., dissenting.
Wm. II. Dabney, A. fi. Culberson, for plain-
tiff in error.
E. N. Rrojles, contra.
Lee L. James vs. E. li. Elliott Equity from
Fulton.
Locniux*. C. J.—When npon the trial of a
bill filed to restrain tbo collection of nots* given
for tbe purchase money of land, both cases, tbe
common lav unit and bill being filed together,
it waa charged that, by the misrepresentation
and fraud of the vendor as to the boundary of
tbe land, tbe vendee mado the purchase, and by
auch fraud he had been misled into expenses in
preparation ao far as making brick, for which
purpose bo bought tho land, and which was
known to the vendor at the time of tbe aalo and
(he court rejected tbe evidence offered by tbe
oomplainant, the vendee, to show his damages
resulting from the alleged fraud and also as to
t le quality of tbe land.
//•Id, That thia ruling by (he court was error.
Coder our law, fraud with injury gives a right
of action. Code 3906 and 3907, and be may re-
oover tho damages, whatever the jury may
Allow in an notion igtiDM him for tho purchase
money, tho rule of estimating damages being
confined to hia actual damage which be has suf
fered by the fraud of the party, the fact of fraud
being for tbe jory to determine.
IIM again, That it waa error to rule out
evidence of the deficiency of the quality of the
land under section 3600 of the Code apportion
ment of the price as well when the purchase
has been by lot as per acre may be bad when
deception or mistake amounting to fraud is
proven, which is for the jury and not the conrt
to determine.
Under our opinion wo hold that the whole
cave, with the evidence offered, ought to have
lieen submitted to thr jury, and let than weigh
it under the legal rulea governing evidence.
Judgment reversed, upon the ground that the
court erred in rejeotiog tbe evidenee offered by
the oomplainant under the facta in this case.
