ment as practicable, to lay off the roada
in aaid oountiea, in motions of throe, flee or
more milea each, aa they or a majority of them
aball deem moat appropriate, the working and
keeping in repair of which, tn accordance with
the road lawaof thia State, for the tormefoM
or more yearn, abaU be let to the toweet bidder,
after doe and proper notice of the tame; and
it ahall be the duty of raid Commiaaionera to
make oot specifications in writing of the work
to be dme, which specification!! nhall be the
baaia of the oontract
See. 3. Be it further enacted by the authori
ty aforeuid, That the perron or persona with
whom raid road contracts may l>e made, aball
be required to gire a bond with approved se
curity, in a sum double the amount agreed to
be paid to him or them under acid contracts,
which bonds ahall be made payable to the Or
dinaries of aaid oounty, and conditioned for the
faithful performance of their respective con
tracts according to the terms thereof, and the
atuna for which said work ia contracted to bo
done, abaU be paid by the Ordinary, only when
the work agreed upon ban been faithfully done,
according to the terms of their respective con
tracts, and the same has been certified by a
majority of aaid Commiaaionera.
Bee. 4. Be it further enacted by the authority
aforesaid, That whenever it ahall be made to
appear to the Ordinary, upon the report of Ihe
Commissioners of any District that the condi
tions of the l>onds required to bo given in pnr-
suance of tho third section of this act have been
violated or not complied with, it stall be hie
doty to have unit inatitnted forthwith againat
the principal and aecoritiea thereon, and the
amount reoovered shall Ire act apart and appro
priated aa a road fund.
(Sec. 5. Be it further enacted by the authority
aforesaid. That Ihe person or person* with
whom aaid contract may bo made ahall enjoy
aU the rights, power* and privileges, and shall
be subject to all the pains and penalties now
prescribed by lew in reference to overseers of
pnblic roads, except ao far as the same may be
affected by thia act.

aforeuid, That in making the sforemontionod
contract*, the Commissioners abaU have power
to pledge to raid contractor or contractors, tho
lalior of such convicts aa may be sentenced by
the Judge of the Superior Court of acid coun
ties to each labor for minor offenses; provided
that aaid contractor or contractors shall make
such provisions for safe-keeping and maintca
anoe of the aame, us shall bo approved by raid
Commissioners under direction of tbe Ordi
nanea and Sheriffs of aaid connUcn.
Hpo. 7. Be it further enacted by tho authority

liea,of three dollars npon each and every person
subject to road duly by erisUng laws in said oonn-
tiea, Ihe payment of which aball operate aa an cx-
emplion from road duly for and daring the year,
for which raid tax may he levied, and ahall also
levy and collect a tax upon the taxable property
of aaid oonnliea when recommended by tbe
Grand Juries of said oountiea, not exceeding
twonly.flve per cent, on tbe amount of the State
tax in said counties, and any person who may
be subject to the payment of raid tax shall be
amenable in all respects to the road laws of i
State, if he or she fail or refuao to pay the
aame.
See, 8. Bo it further enacted by ihe anthori
ly aforesaid; That all citizens of the city
Macon, as well aa citizens of oilier portions
the county of Bibb liable to road and street
duty, ahall be liwblo to Ihe provisions of this
aot, and nothing herein contained ahall bo con
strued to relieve any citizen of tho city of Ma
con from liabiliuos to pay the streot tax now
authorized by the charter of aaid alty.
Bee 9. Bo it further enacted by the authority
aforeoaid.That it shall he the duty of the Commis
sioners of the several districts of raid counties to
aaoertain and report to the Tax Colleetors
said counties the names of each and every per
son in their respective districts who may be sub-
jeot to road duty, and givo tbe same to tho Tax
Collectors. And it shall bo the duty of the said
Tax Collectors to collect tlio tax which may
levied in pursuance of thia aot at such times
the Ordinaries may direct, and shall report
the aaid Ordinaries tbenaroesof all persona who
, fail or refuse to pay mid tax.
Bee. 10. Be it further enacted by the an
thority of the same. That any person or persons
subject lo road duty who shall prefer to work
the road in person or by proxy ahall have tbe
right lo do ao, and ahall work six days in the
year on the roada in tho districts under tbe di
rection of tbe oontraotor for the aame, whoae
receipt for snob good labor ahall be good
againat the capitation tax, and be charged
aa osah against raid contractor, and any
person failing or refusing to pay the com
mutation tax for road duty shall bo subject to
all the penalties already provided by law, and
hla wages be subject to garnishment by the Tax
Collect or, whose duty it aball be to proceed by
execution or garnishment againat all defaulter*
by summary process as at present provided by
law.
Bee. II. Be it farther enacted by the anthori-
ty aforesaid. That Ihe Tax Collectors of said
counties ahall be entitled to the aame per cent,
upon the collection of said road taxes as is a!
towed by law for the collection of State taxes.
Bee. It’. Be it farther enacted. That raid
Commiaaionera ahall hold their offico for the
term of four year*, excepting tboao flrat . looted,
one-half of whom—to be determined by lot on
their flrat meeting—ahall hold aaid office for
the term of two years. Upon the expiration of
the term* of said Commiaaionera, their suooeas-
on shall be elected by the Grand Jury, which
shall flrat, thereafter, be in session in said conn-
tie*; and all vaoanciea by death, resignation, or
otherwise, shall be filled for the unexpired
terms. In the acme manner, and the result of
all regular and special elections of aaid Com -
mission*r* shall constitute a portion of the
special presentments of said Grand Juries, and
wheo any Grand Jury shall fail to discharge
any duty herein specified, tbo next anooeeding
Grand Jury shall discharge aaid duty.
Sec 18. llo it further enacted. That said
Commissioners ahall meet at the capitals of their
respective counties on the first Saturday in
January, April, July and October, of each veer,
for the transaction of business, and aball'bave
power to adjourn from day to day. Special
meetings may be called by any three of tho Com
missi oner* npon personal notice in writing to
ail tho Commiaaionera in the rennty at raid
time, or npon publication in a public gazette of
the eapitol of each county ten days befoio the
date of meeting.
See. 14. Beit farther enacted by the authority
aforesaid, That all laws and parts of laws mili-
tating against this aot be and tho same are
hereby repealed.
