discussed by the Judiciary Committee, before
it determined by a majority to exclude Mr.

ed more than a month before that event oc
curred—was not a member himself, end was

The Senate agreed to the house amendment

sippi. It goes back to the House for concnr
ence.
Mr. Sherman’s railroad bill came up but
was postponed. -
The death of Hinds was announced from
the House and the Senate adjourned.

sion of Bontweli’s bill for manhood suffrage,
and the enforcement of the 14tb amendment.

press dispatch, from this city, it was stated

that Circuit Judge Pelham had decided that
the Alabama Legislature was not a legal body,
and that Wm. H. Smith was qot a legal Gov
ernor. The dispatch correctly represented
the statement of the paper referred to, but the
facts in the case are these: A racnacy in tha
office of Probwto Judge of Shelby connty wae
reported to the Governor, who wua required
by the Constitution to issue a commission to
fill the vacancy. Afterword a question arose
as to whether them was reajly a vacancy. In
determining tto* question, Aodge Pelham de
cided that if bad J not occurred in
the manner prescribed by law the Governor’s
commission, designating another mao for the
office, was nail and void. The deoision re
lated in no way to the validity, to either the
Legislature or to the Governor's office.
