Must Pay Rentals
Landlords Must Receive
Their Due on Property
‘Macon, Ga.—ln the case of
Jacob E. Gutman, an alleged
bankrupt merchant of Savannah,
in which a petition for review of
the referee’s report is brought by
the Rt. Rev. Cleland K, Nelson,
Episcopal bishop of the diocese of
Atlanta, and the Episcopal church
in the diocese of GGeorgia, to pre-|
vent the trustee of the bankrupt
estate from selling the lease on
valuable store property in Savan
nah, Judge Speer yesterday direct- ]
ed that the lease be resold and the,
rentals due the church be paid
from the proceeds, In the event}
that the sale did not bring a sufii-%
cient sum to pay all of the rentals,
the court ordered that the land
be returned to the owners and the
rentals paid, |
In the summing up of the case
in his opinion delivered in court
yesterday, Judge Speer said:
“We think it our duty, there
fore, to send this case back to the
referee and direct that this lease
be rosold at an upset price suffi
cient to pay to the authorities of
the church the entire rentals for
the term of the lease, and that the
trustee should pay over such ren
tals for the entire term of the
lease as soon as he receives them.
On failure to sell the lease for a
sum suflicient to pay down all the
rentals due for the term of the
lease, order should be taken to re
store at once the property in its
integrity to the owners, and be
sides to pa) the rentals already
accumulated, and other proper
charges under the lease. The same
equitable result may be secured if
the referee, in his judgment,
should accept & bond, with ample
security to be approved by him,
obliging the purchaser at the sale
to conform strictly to ali the terms
of the lease.”

for review, and Remer L. Den
mark, of Savanpak, trustee, in
propria persona, and Garrard &
(zazan, of Savannah, were attorn
eys for the bankrupt.
In the Meyer case, one involv
ing big land interests in Georgia,
JudgeSpeertook toomuch the same
stand. In this case, in which the
opinion of the judge was recently
affirmed by the United States su
preme court, Judge Speer held
that the landlord was entitled to a
superior lien on the bankrupt’s
assets for his rent, In the Gut
man case he holds that the lease
hold interest ot the bankrupt may
be sold for enough to pay all the
reptals and that if there is not
enough derived from the sale of
the lease, it is the duty of the re
feree to return the property to
the landlord.
LaGrange Wins Next
State Press Meeting
Dublin, July 17.—At the clos
ing session ot the (Georgia Press
Association this morning, La-
Grange was selected as the next
meeting place of the association,
and the following officers elected
for the coming year: Fresident,
C. M. Methvin: first vice-president
P. T. McCutcheon; second vice
president, R. Y. Deckham; cor
responding secietary, H. M, Stan
lay; recording secretary, W. A;
Shackelford; treasurer; B. T.
Moseley.
All of the old oflicers were re
elected with the exception of sec
ond vice-president, which officer
went to R. Y. Beckbham, of the
Laurens County Herald, Dublin.
The vote for LaGrange was unani
mous, the sentiment being so
strong that no other city was plac
ed before the convention.

Foster Clan Will
Support John Slaton
~ Atlanta, July 18.—Jobn M,
Slaton was surprised the other
day to receive letters from the
sons and grandsons and other male
relatives of A, L. Foster, of Clay
county, announcing that the whole
family bad decided to do every
thing they possibly could for Mr.
Slaton in his race for governor,
Several of these gentlemen Mr.
Slaton has never met personally,
and for that reason he was all the
more gratified. The letters ex
plained that the rallying of the
Foster clan was due Mr. Slaton’s
action in championing A. L. Fos
ter’s cause in 1896. Mr. Slaton
led the figkt on the floor of tne
house in Mr, Foster’s favor when
effort was made to oust him in
favor of Killingsworth. {

Will Test Lawi
If Measure Becomes Such
Atlanta, July 18.—The express
companies and railroads will un
questionably put to a quick test
the. constitutionality of the new
liquor shipment measures passed
by the senate, in the event thev
become a law. The one measure
which provides that the carriers
shall furnish to ordinaries of each
county a list of names of all who
receive liquor shipments, will be
flatly defied, and from the first the
state will be forced to prove the
constitutionality of the measure.
The stamp measure, by, Senator
Felker, is another question. It
provides that all shipments must
be stamped with & state revenue
stamp before they are taken out
of the express offices.
Monkey In The
Role of Burglar
Atlanta, July 18.—A monkey
w h ose burglarizing ingenuity
‘made him appear a lineal descend
ent of the famous Rue Morgue
simian broke into a local seed
store yesterday afternoon and
played havoc with the contents.
Not only did he throw all the big
books of the company around the
store, but upset seed barrels and
boxes. The proprietors returning
this morning thought the place had
been burglarized, ana were sur
prised to find the safe had not
been blown. _

ing ruined through the agency of
general delivery letters, Postmas
ter Hugh McKee is going to ask
the postal authorities at Washing~
ton to help curb the local evil. He
isays every day young girls of six
teen get love letters from the gen
eral delivery, doubtless unknown
to their parents, The girls adopt
that way of carrying on corres
pondences which their mothers
would not permit, he declares.
