Atlanta, Sept. 24.—1 n at least
one instance recently, word has
come to Governor Brown that if
certain jurors in a capital case had

on the different grades of homi

been different. The information
cameé when it was too late, the
defendant had paid the peaalty
with his life. : |
This and previous instances of a
similar nature have led (jovernori
Brown to do a little speculating.

VOL. XVII. NO. 74
‘enough to serve on juries, should
misunderstand the law relative to
homicide in its various degrees,
when it is carefullv stated to them
by the court, and vet it is said
there are frequent arguments in
the jury roow as 1@ just what the
judge said. s
Governor Brown belieyes that
}this difficulty can be largely over
come if the law is so changed as
!to require the judges of superior
courts to submit their charge up
;ou the law to the jury in writing.
| This would not only put it specifi
cally and clearly before the fury,
'so that but ane eonstruction could
I‘.‘C placed upon it, but it would do
with the now freQuent necessity
for recharging the jury in ordinary
cases. Governor Brown will em
'body his ideas upon this subject

ilature next summer,
