ORDINANCE NO. 348.
n Ordinance to Assess the Amount to be Paid by Property Owners
Owning Property Abutting on Certain Streets in the City of
Fitzgerald to Pay for the Paving of Such Streets. ‘
SEcTION 1. Be it ordained by the Mayor and Council of the
ity of Fitzgerald, and it is hereby ordered by authority of the
ame, that for the purpose of paying the costs of the improvement
f Central Avenue from the ally lying parallel between Thomas and
Sheridan Streets, west to and across Johnston Street; Johnston
gtreet from Central Avenue north to the tracks of the Atlanta,
Birmingham and Atlantic Railroad Company; Pine Street from the
point where the paving of said street terminates at Sherman Street
east to and across Sheridan Street; Main Street from a point where
Pine Street intersects it on the south; nor to Central Avenue; Sher
man Street and Sheridan Street between Central Avenue and Pine
Street, which costs have been prorated on the real ¢state according
to its frontage on said streets or portions of streets so improved,
there be and there is assessed against che following lots in the fol
lowing sqares and blocks the several amounts set opposite said lot,
square and block numbers, viz: |

Sgc. 2. Be it further ordained that said assessments shall be
due and payable within ten days from the date of the passage of this
ordinance and collection thereof shall be enforced in the manner pro-‘
,vided by Section 68 of the Charter ot the City, as amended by Act of
the General Assembly approved Augusy 17, 1908; provided that the
|owner of any lot or lots who within said ten days shall sign an ac
knowledgment and waiver and promise in writing to pay his assess
ment with interest thereon at the rate of six per cent per annum, pay
able annually, may pay his said assessment in two equal annual install
ments the first installment to be paid on or before October 1, 1913,
and the second installment on or before October 1 1914.
| For such assessments for which acknowledgment, waiver and
‘promise are filed there shall be issued and delivered to the contractor
to apply on contract for making said improvements certificates of in
debtedness to which certificates shall be attached such acknowledgment
waiver and promise of the property owner, which certificates, and
acknowledged waiver and promise shall be in substantially the fol
lowing form: :

STREET IMHROVEMENT CERTIFICATE. .
KNOW ALL MEN BY THESE PRESENTS: That the City
of Fitzgerald in Ben Hill County, Georgia, is indebted to Alabamsa
Paving Company in the sum of ————— ——Dollars for the construc
tion of the improvement of the street and sidewalk upon which the
hereinafter described real estate abuts, viz: Lot number——in square
Number———, Block-————, in said City, which amount has been
prorated and assessed against said real estate, and is a valid and sub
sisting lien thereon, and the said City herety convenants, promises
and agrees to collect said assessment, together with interest thereon
at the rate of six per cent per annum, payable annually, and to pay
the proceeds thereof to the Alabama Paving Company, or holder of
the coupons hereto attached, as provided in said coupons, on presen
tation and surrender of said coupons as they respectively mature, at
any bank in tke City of Fitzgerald, Georgia,
It is hereby certified, recited and declared that all acts, condi
tions and things required to be done precedent to and in the assessment
of the cost of said improvement upon said real estate, and the issuance
of this certificate, have been properly done, have happened, and have
been performed, in regular and due form, as required by the Consti
tution and laws ot the State of Georgia and the Charter of said City;
that the party executing the acknowledgmert and waiver hereto at
tached, was at the time of executing said acknowledgment and waiver
the legal owner of the real estate herein described; and that for the
performance of the convenants hereof the faith and credit of said City
are hereby pledged. '
In Testimony Whcreof, We, the undersigned, officers of the
City of Fitzgerald in Ben Hill County, Georgia, being duly authoriz
ed to execute this obligation en behalf of said City, have hereunto
signed our names officiallv, and affixed the seal of said City, as of the

ACKNOWLEDGMENT AND WAIVER OF
PROPERTY OWNER.
The undersigned, owner of the real estate described in the above
and foregoing certificate, does hereby acknowledge that there is due
to the said Alabama Paving Company the amount evidenced by said
certificate; that *he City of Fitzgerald has a valid and binding lien
upon said real estate for said amount; and that, in consideration of the
privilege of paying said assessment in two annual installments, he
hereby waives any and all irregularities in the proceedirgs precedent
to and in she levy of said assessment on his said real estate and does
hereby covenant, promise and agree to pay said assessment to the
City of Fitzgerald in two equal annual installments, the first linstall
ments to be paid on or before October 1, 1913, and the second install
ment on or before October 1, 1914, together with interest thereon at
the rate of six per cent per annum, payable annually.
In Witness Whereof I bave hereunto subscribed my name as of

COUPON NO. 2.
On October 1, 1914, the City of Fitzgerald in Ben Hill County,
Georgia, hereby covenants, promises and agrees to pay Alabama
Paving Company, or bearer,——————Dollars, at any bank in said
City, being the second or last installment of the assessment evidenced
by its Street Improvement Certificate number———,dated -————
i 1912, together with one year’s interest on said second or last install
ment of said assessment,

COUPON NO. 1.
Oan October 1, 1913, the City of Fitzgerald in Ben Hill County,
Georgia, hereby covenants, promises and agrees to pay to Alabama
!Paving Company, or bearer,—————Dollars, at any bank in said
City, being the first installment of the assessment evidenced by its
Street Improvement certificate number—————, dated—————,
1912, together with one year’s interest on said assessment,
Clerk.
Said certitieates shall be dated as of the date of the final passage
of this ordinance, and the Mayor and Clerk are hereby authorized and
directed to execute and deliver said certificates as herein provided.
Skc, 3. Be it further ordained that all ordinances and parts of
ordinaces in conflict with this ordinance be and they are hereby re
pealed.
