The decision rendered by the
Judge of the United States Court
in Jacksonville if upheld by the
Supreme ;Court, will prohibit the
wholesale liquor business as carried
on in the cities of Macon, Savan
nah and Augusta. What seemed
impossible to the State under Gov.
Smith and Brown has been accom
plished by the wholesale liquor
dealers of Florida. Under the de
cision they have effectively puta
crimp into the illegal traffic in
Georgia. A dispatch from Jackson
ville Fla. says: 'ln restrainiag the
Southern Express Company from
carrying liquor from one point to
another in the state of Georgia
Judge Cheney in Federal Court
here, declared he had no jurisdic
tion in the case in the following
language:
“In the consideration of this case
the first question to be met is that
of the court'’s jurisdiction, and cites
in support of his contention Atlan
tic Coast Line Railroad Company
vs. Macon Grocery éo 166 Federal
report® 306, same, Macon Grocery
Company vs Atlantic Coast Line
Railread, 215 United-States reports
501.
“In the opinion of the court, ju
risdiction in this case is based on
the diversity of citizenship of the
parties alone. No Federal ques
tion is involved. The relief pray
ed might be granted by a court of
equity in the state of Georgia
either the state or Federal court
there, and the bill could not be sus
tained in this court if thc diversity
of citizenship was not alleged . ‘
'COURT CLAIMS RIGHT TO ENJOIN NUISANCY
“The next important question is,
’whether or not this court can en
join the respondent from commit
ting the facts complained of in the
state of Georgia, Upon this ques-!
tion the authorities seem at first to}
blush to be involved and conflict- |
ing. But a careful analysis of !
cases decided by the Federal courtsi
where the property injured is with- '
in the jurisdiction of the court, a\
nuisancecan be enjoined in anoth—[
}er state or district if the court has
jurisdiction of the offending party.‘
“This doctrine is clearly announc
ed in the Salter Sea cases, 172 Fed-l
eral reports, 812, and 215 Unitedl
States supreme court reports, 604
In these cases ths circuit court of
appeals of the Ninth Circuit found
it within its power to enjoin a nui
sance committed in Mexico. These
cases were affirmed by tne Su
preme court, 215 United States su
preme court reports 604.
“In this case the nuisance com
plained of is located in Georgia,
but the property injured, namely,
the legal business of the complain
ants, is located in this district. and
this court has jurisdiction of the
party complained of as commutting
the nuisance.”
