The petition of Newton Johnson and Frances John
son respectfully show, that James Gibson, Jun., in his
life t ne, to-wit: on the eleventh day of September,
eighteen hundred and forty-seven, made and deliver
ed h s certain instrument in writing, commonly called
a bo id for titles to land, to one John J. Moore, condi
tiohtd as loiiows: “ That, whereas the said John J.
Moore has this day p trehased of the said Janies Gib
son, Jun , a certain tractor parcel of land containing
one-hundred and fifty acres, more or less, it being
known and dtsting tished as a part of No. one hundred
aud sixty-four, in th • twenty-second District,ot'origin
ally Muscogee now Talbot county, and has given his
cermin promissory notes, payable oh the twenty-fifth
of December, eighteen hundred and forty-eight. Now
if the said John J. Moore, well and truly pays or
causes to be paid, the above said notps and the said
James Gibson, Jun., does make, or cause to be made,
good and lawful titles to said parcel of land, then and
in that case the above bond lobe void,otherwise to
remain in full so ce and virtue.” And that the said
John J. Moore di I, on the 7th day of December, 1850,
transfer said bond to your petitioners for a valuable
consideration, and your petitioners further show that
the said James Gibson, Jun., has departed this life
without executing titles to said land, or in any way
providing therefor. They therefore pray this Court to
grant rh'til a rule, directing the Executor of the said
James Gibson, Jan., to execute to them titles to said
land, in conformity with said bond. i
Wherefore, it is ordered b. the Court, that this rule
be published in the Georgia Journal &s Messenger
once a month for three months, notifying and requi
ring all persons concerned to show cause, if any they
have, why said Executor should not be required to
make titles to said land.
