The course of public justice in North
Carolina Is at a dead lock with the senti

There is hardly a State of the Union in
which the corporeal punishment of crim
inals is not practiced either as a first or
last resort; for it is a part of the discipline
df mo&t penitentiaries, where criminals
prove too refractory to submit to milder
arguments. Experience has proved it a
mild, humane and efficacious penalty in
certain cases, and to suppose that there is
more degradation in tba lash than in the
shaved bead and grotesque apparel of the
penitentiary prisoner, is a nice discrimi
uatiou of taste and delicacy which hardly
w arrants the suspension of the law.
Particularly ludicrous is this pretence
coming from quarters which have sus
tained in oourts the application of stripes
to young ladies of mature age in institu
tions of learning, sod which in army
discipline practices corporeal punishment
far mere painful and, it seems to us, not
less degrading tbau the cat. A soldier
slung up by the thumbs, (which no doubt
General bicklea has often seen) is certain
ly not an object of Jess persona! Indignity
tbsn when smarting under the rod. Tbs
disgrace to any culprit ia not the punish
ment, but the o9en.es, and the man who
baa so lilt:e se)'-respect as tc steal, Is not
debased, but warned, by sc gentle a re
minder on the bare back, of the public
contempt lu which the crime Is bold.
There never was a time on the North
American continent, particularly In the
Northern part of It, when crime of ail
kinds stalked abroad so uublusbingly and
in such force. Murder, rape, arson, high
way robbery, theft, defalcation and breach
of trust crowd the papers in gloomy and
disgusting detail and prove beyond con
troversy that there is something vitally
defective in the administration ofjustice.
The system, so far from being past Im
provement, does not atfswer the ends of
good government, and there is less reason
why the North,than why North Carolina,
should »e< up a claim for superiority.
The Stay Law
The Governor acted his part wisely and
manfully in vetoing the Slay Law, al
though it did no good. The veto was over
ruled In the Senate by a vote of 21 to S
and in the House of 106 to 7. It is, how
ever, what Mr. Benton used to call “ a
question of goals’ wool." The Supreme
Court of the Btate, we have no doubt will
shortly affirm the unconstitutionality of
the act, if, Indeed, Congress allows that
tribunal the breath of life long enough for
that purpose ; and whether It does or not,
perhi ps the State Judiciary will soon be
aupereeded by United States courts or
civil courts and their ministers alike al*ol
iahed. The beat thing parties litigant, lu
our judgmeut, can do, under the extraor
dinary circumstances of the case—the rev
olutions with which we are threatened,
and the suspense and uncertainty of every
thing, is to compromise. Let the creditor
give time and the debtor security, and so
work along in a friendly wav and await
better times

North Carolina a republican form of Gov
ernment," introduced into the House on
Thursday, and referred to the committee
ou Territories, not Improbably developes
a scheme which will be applied to all Use
unrepresented Bouthern btates It meets
the ardent drift of sentiment in Congress,
and Is absolutely more liberal than the
t*rmßlaid down In BroomaU'B resolution,
inasmuch as It dees not exclude'be South
ern white population from the ballot boi.
The bill, as portrayed by our very copious
telegrams yesterday upon the subject, does
not even provide fora provisional govern
ment or a government ad interim, al
though It annuls the existing government
aud declares the functions of all State of
ficers at an end. It simply devolves upon
theL. 8. Marshal the duty of opening
and superintending the polls at elections
ordered by the act, and requires the Pres
ident to use the military and naval power
of ths L ulted States !u the enforcement of
the law’. Civil order, therefore, during
tie interregnum will be maintained by
the military authorities lu command of
the various departments.
Mr. elevens' billgives the suffrage to "all
male resident citireusof twenty-one years
of age and over, without distinction of col
or, who can read or write, or who are
worth SIOO or more," but requires dele
gates to the Constitutional Convention

afforded me; that I was opposed to a con
tinuance of the war, or the establishment
of the so-called Confederate government,
and voluntarily give no aid or encourage
ment thereto, but earnestly desired the
success of tho Union ; that I will lienees

Such is Mr. Bteuen;,’ scheme, which the
telegiam assures us has taken the wind
out cf the sails of ail the other radical
p ojectors, and we are of opinion that It
foreshadows substantially the plan which
will prevail. At all events, it Is quite as
''liberal'’ as any which w e have reason to
anticipate from this Cong ess.
It contemplates very rapid work, so that
in all probability the whole ten States
put through’’ in thccourse of the
next summer, congress leuialning (accord
ing to the existing programme; In perma
nent session to perfect the business. But
even the Mates so reorganized, v ill i lo t'
according to the caucus arrangement, be
permitted either representative In Con
gress or a vote in the uert Presidential
election. Doubtless, however, this Inter
dict may be reruo\ed if it shall lie discov
ered that the reorganized States have suf
ficient enlightenment to vote with the rad
ical party, it does net need, but probably
would not de6t«ise Southern help.

The Guillotine
A late meeting of the Paris Academy of
Science was entirely devoted to a
drawn up by Mr. Dubois, which treated of
questions which cannot fail to excite gen
eral interest via: Who waatbe first orig

quote from the report of the dlcusaion :
‘Tt is generally believed that the guillo
tine wab invented by a Ireuch surgeon
whose name was Ouillotin. This, how
ever, appears to be au error, inasmuch as
the first originator of the idea seems to
have bteu a eurgoon oi the Dame of Louis.
It would, m fact, appear, acoording to the
revelations which have been made by this
learned body, that in 1792, Dr. Louis, Sec
retary to the Faculty of Burgery, directed
a German mechanic of the name of Smith
to construct a machine, with which he
made experiments on the dead bodies is
suing from the hospital at Bicetre. But
by glvlug the knife au oblique direction,
he accomplished the decapitation of heaps
with wonderful rapidity. The first time
the sentence of death was carried out by
means of the guillotine, waa n the S&tb of
April, 179!!. The criminal was a high
wayman The first execution of a politi
cal prisoner of this means took place on
the 21st of August of the same year. From
that memoraple night the guillotine waa
kept so constantly at work tuat in July,
1794, the difficulty was to find a means of
of disposing of the oorpset of its victlms.
It only took thirty minutes to decapitate
the twenty one Giroudiste whom it was
the good pleasure of the Revolution to
doom to death. The question Mr. Dubois
treated le one of the extreme interest. He
inquires: Can life exist for any length of
time lu the head after It has bveu severed
from the body? When this sublect was
first investigated, a belief prevailed that
decapitation caused attrocious suffering,
bammeranr asserted that as the soul exist
ed in the head, the agonies endured
must be frightful; he main talced that
the sensations were not only physical but
moral, and in proof of this theory quoted
the story of Charolotto Ccrday having
blushed when the executioner struck her
cheek. Professor Bue went still further,
aud asserted that paiu was felt, not in the
head alone, but in the truDk and limns.
M. Dubois does not admit the possibility
of suffering after decapitation. He writes
thus: "Every circumstance tends to the
conviction that the victim neither experi
ences paiu during nor after decapitation
by the guillo ine. I say everything con
duces to this belief, a* necessarily we can
have no proof ou the subject.” Several
physiologists, however, differ from this
opinion. Putting aside a!! theoretical
considerations, we may say that very ex
act experiments appear to demonstrate
that decapitated animals experience sen
sation aud suffer during several minutes
after their heads have fallen beneath the
butcher’s axe. Experiments were made
about thirty years ago in the shambles of
Paris, under the superintendence of the
Couservateur. He gave it as his opinion
that death by means of the blow of an iron
club produced intense pain, and he wish
ed to ascertain whether decapitation would
cause a lets degree of suffering. Experi
ments were made on a hundred cows, and
ou au equal number of calves and sheep,
aud proved that the suffering after decap
itation was great. During the first min
ute after execution the facial muscles were
agitated by frightful convulsions, the
mouth alternately opened and closed, the
respiratory organ of the face worked, and
the animal appeared to experience intense
agony, andanimperativedesire tobreathe.
On placing a finger within an inch and
a half of the eye, It suddenly closed and
opened again. Therefore, the animal dis~
distinctly perceived the approach of a
hand to its eyes. At the end of a few sec
onds, tbece phenomena ceased altogether.
Professor Bonchut likewise made experi
ments on the aDimals in the Paris sham
bles, aud also recognised that the death of
the brain did not occur for three or four

The other day a communication appear
ed in the Troy Whig, written by a resi
dent of that city who may be set down as
"the oldest Inhabitant.” Some of his re
memberances are inconveniently intricate.

scoundrels, says thefeavanuah Advertiser,
to swindle the freedmen outer tbeircotton
by buying it with counterfeit greenbacks
has just beeu brought to light on the Sea
Islands. General Bcott, of the Freedmen’s
Bureau, is doing his best to ferret out tbe
perpetrators of this piece of heartless
kuavery.
