AN ACT.
To regulate the rates of tavern li
cense in this state.
Sec. 1 RE it enacted by the Se
nate, House of Representatives
ol the State of Georgia in general
As sen.bly met and it is entcitd by
the authority of the same, That
from and after the passing of this
act, each person obtaining tavern
licenses, shall pay for sncti license
the sum of five dollars, any law
to the contrary notwithstanding ;
| provided, nothing in this ace
j shad be construed to controul
the rates which now are, or may
be established by the corporations
of Savannah and Augusta, or any
; other incorporated town in the
! atate.

state.
Whereas ® practice has been a.
dopted and now prevails m some
parts of this state, of bringing
suits ro the Superior and Infcri <r
courts for dtb s which cou.stiiu. i
tionallv are, and by law ought to
be exclusively cognizable in the
justices’ courts; which practice
is injurious it oppr»*sive on many
of the goods citizens of this state ;
by subjecting them to more cost
than was contemplated by the con
atimibn and judiciary laws of this
atate j lor remedy whereof ;

Senate and House of Represents-

General Assembly met, and it is
enacted hn - the authority of the
same, Thai fchere any suit t,hall b«
brought to the Superior or inferior
courts in thi* state, and the ver
dict of th. jury shall be for a sum
under thirty dollars, the defendant
shall not be charged with more
cost than would have neccessarily
accrued, provided said recovery
had been before a justice of the
peace ; aud the remainder of the
cou;t charges may be retained out
of the sum so recovered ; and if
the virdict ol th* jury he not
ot sufficient amount, the plaintiff
shall fie bound io pay the same ;
provided thi* act shall not extend
to, and govern cases where the de
mand set forth in the declaration,
