Ihall be furveyed in townfhips

the lands be fuiveyed in a diffe

lots.
Sec. i. And he it further
cradled. That the fecretary of
the treafury fhall, from time to
time, and whenever the quarter
ly accounts of the receivers of
public monies of the feveral
land offices dial) be fettled, pay
three per cent, of the nett pro
ceeds ofthe lands ot the United
States, lying within the State of
Ohio, which fince the 30th day
of June lad have been, or here
after may be fold by the United
States, after dedufting all cx
pences incidental to the fame,
to fucli perfon or perfons as may
be authorized by the legiflature
of the. laid date to receive the
fame, which fums thus paid
(hall be applied to the laying
out, opening and making roads
within the laid date, and to no
ether purpofe w hatever; and an
annual account of the applica
tion of the fame fhall be tranf
mitted to the fecretary of the
treafury, by fuch offi:erof the
date as the legiflature thereof
Ihall direft ; and it is hereby
declared, that the payments thus
to be made, as well as the feve

made by the preceding feftion,
are in conformiy with, and in
condderation of the conditions
agreed on by the Stare of Ohio,
by the ordinance of the conven
tion of the faid date, bearing
date tjie twenty-ninth day of
November lad.
Sec. 3. And he it further
enabled) That the feftiom of
lard heretofore promifed for the
ufe of lefnob, in lieu of fuch
cf the left ions No. 16, as have
been otherwise difpofed of, (laail
be lelcfted by the fecretary of
the trea/ury, out of the unap
propriated referved left ions in
the moll contiguous townfhips.
Sec. 4. And he it further
cradled', That one complete
townlhip in the State of Ohio,
and Didrift of Cincinnati, or fo
much of any one complete
towndupv. ithi.Tthe lame, as mav
then remain unfold, together

as Ihall have be n fold in the
faid town fh ip, fo as o make in
the whole thirty-fix fe ft ions-, to
be located under the direftion
of the legiflature'of the faid date,
011 or before the fir/l day of
Oftober next, with the regider
of the land office of Cincinnati,
be, and the fame is hereby ved
ed in the legiflature of the State
of Ohio, for the purpofe of ef
rablifiling an academy, in lieu of
the town/hip already granted for
the fame purpofe, by virtue of
the aft entitled, ft An Aft au
thorizing the grant and convey
ance of ccrtam lands to John
Cleves Sin>rnes, and his afib
ciates:” Provided , however,
that the fame fhall revert to the
United States, if within five
years after the paffing of this
aft, a townfhip fhall have been
lecured for the faid purpofe,
within the boundary of the pa
tent granted bv virtue of the
above-mentioned aft, to John
Cleves Simmes, and his aflb
dates.
Sec. 5. And be it further
cradled, That the attorney gene
ral for the time being, be di
rected and authorized to locate
and accept from the faid John
Cleves Simmes, and his aflb
ciates, any one complete town
fhip, wdthin the boundaries of
the faid patent, fo as to fecure
the fame for the purpofe of ef
tablifhing an academy, in con
formity to the providons of the
faid patent, and in cafe of non
compliance, to take, or direft to
be taken, fuch meafures as will
compel an execution of the
tniil: Provided however , that
John Cleves Simmes, and his
aflbeiates, fhall be releafed from
the faid truft, and the faid town
fhip Hull veil in them, or any of
them in fee Ample, upon payment
into the treafury of the U. States,
of fifteen thoufand three hun
dred and flxty dollars, wdth in
terefl from the date of the
above-mentioned patent, to the
clay of fuch payment.

That a fum not exceed
ing twenty thoufand dollars, in
cluding any unexpended balance
of former appropriations for the
fame object be, and the fame
hereby is appropriated for de
fraying the expence of any trea
ty or treaties which may be held
with the Indians : Provided , that
the compenfation to be allowed
to any commifiioner appointed
or who may be appointed, for
negociating fuch treaties (hall
not exceed exclufiveoftravelling
expences the rare of eight dol
lars a day during the aflual fer
vice of fuch commifiioner.
Sec. 3. And he it further
enabled y That the fevcral appro
priations herein before made,
fiiall be paid and difeharged,
fiift out of any balance remain
ing unexpended of former ap
propriations for the fame objeds
refpedively, and fecondly, out
of any monies in the treafury
not otherwife appropriated.
