tition of John II. R. Justiss, that John Fain, late of
said county, deceased, did, on the 14th of January, eigh
teen hundred and thirty, execute his bond to your petitioner
for titles to lot of land number sixty-nine, in the nineteenth
district of originally Laid win but now Morgan couniy, con
ditioned, that, whenever the said John H. K. Jnstiss should
pay him (the said John Fain) seven hundred dollars and
demand title, the said title should be made and delivered;
and the said john Fain having died without executing titles
to your pr titioner, agreeably to the tenor of said bond, and

Bulges, late of said county, deceased, did, while :n
life, to wit, on the second day of April, one thousand eight
hundred nnd thirty, make and execute, to John C. Burger,
her certain writing obligatory, by which she hound hersell, .
her heirs, executors, administrators and assigns, to makecr
cause to be made, unto the said John C. Burgee, his heir* or
assigns, good and sufficient rights and titles to a certain lot
ofland known as lot number one hundred and twelve (112)
in the twenty seventh (27th) district of Dee county, when
he, the said John C. Burges, should take the pltti ond grant
for the same out of the office; and that the said John C.
Burges did afterwards, to wit, on the 18th day of Decem
ber, 1832, dulv assign and transfer the said bond toJantf
Sanders; and it further appearing that the said Eleanor
Burges departed this life intestate, without executing title*
in compliance with the said bond;
It is, therefore, on motion oj the said Jumes Sanders, or
dered by the Court, That all persons concerned show cause
