AN ACT to alter and amend the several Judiciary act
now in force this State, so far as relates to Justices
Courts, approved December 14th, 1S11, so far as lo change
l he time of holding Justices Courts in the districts in the
several counties in this Slate, from once a month, to once
in every four months, in each year.
Section I Be it enac ted by the Senate and House of
Representatives of the State of Georgia, in General Assem
bly met, and it is hereby enacted hy the authority of the
snmo, That from and after the passage of this act, ill • Jus-
fices Courts in the several districts in the several counties
in this State, shall he held in each district one * in every
four months in each and every year; the first Courts in
each district shall be held in the month of January after the
passage of this act, and once every four months thereafter,
on such day as the said Justices in each district may desig
nate, and no term of said Court shall he more than two days.

AN ACT lo repeal an act entitled an act to extend the time
for fortunate drawers in all the Land Lotteries, and in the
Gold Lottery, to take out their grants, assented to lOih
December, 1841, and to limit the lime for the fortunate
drawers in said Lotteries, to take out their grants; and to
provide for the disposition of the same, it not granted
within the limitation; and to provide for taking out head
rights
Section 1. Beit enacted by the Senate and House of
Representatives of ihe State of Georgia, in General Assem
bly met, and it is hereby enacted by tlie authority of the
same, That an act entitled an act to extend the tiim for the
foriuuute drawers in all the Land Lotteries, and in the
Gold Lottery, to take out their grants, except in the counties
hereinafter excepted, assented to 10th December, 1841, be
and the same is hereby repealed
Sec. 2. And be it further enacted hy the authority afore
said, That the fortunate drawers in tlie Land Lottery of
1821, embracing the counties of originally Dooly, Houston,
Monroe, Henry and Fayette; and the fortunate drawers in
ihe Land Lottery of 1827, embracing the counties of Lee,
Muscogee,Troup, Coweta, and Carroll; and the fortunate
drawers in the Land and Gold Lottery of 1832, embracing
the county of originally Cherokee, hut now Cherokee, For
syth, Cobb, Cass, I.umpkin, Gilmer, Murray, Walker, Paul
ding, Dade, Chattooga, Union, and Floyd, shall take out
their grants on or before the first day of July, eighteen hun
dred and forty-three, or the same shall be considered ps re
verted to the State: Provided always, That the operation of
ibis act shall not apply to lands drawn by orphans, until
twelve months after tlie youngest one shall have obtained
the age of twenty-one years, only so far as lo authorize the
commissioner, or commissioners, to issue a certificate to the
highest bidder, as hereinafter provided. But a grant in no
instance shall issue on said certificate, until the purchaser
shall file the affidavit of two or more respectable witnesses,
that I he privilege of the orphan or orphans under provis
ions of this act, have expired: Provided turlher, Fliat if any
person shall apply for a grant for any of the lands mention
ed in this act, at any time before th*- first day of July next,
and leave the price of the sam" and the grantor grants
cannot he prepared in time that the proper officers shall he
and they are hereby required lo issue grants as of the date
of the application.
Sec. 3. And be it further enacted by the authority afore
said. That said ungranted lands shall he exposed to sale, at
public outcry, belore the Court House door in the several
counties where said lands are situated, by one or more com
missioners to be appointed by the Executive, who shall give
bond with good and sufficient security to the Governor and
his successors in office, in a sum not less than doub.'e the
amount of the grant fees accruingto the Slate from the
number of ungranted lots in the county or counties in
which he may be a commissioner.
Sec. 4. And he it further enacted hy the authority afore
said, That said commissioner or commissioners shall ad
vertise the times and places of said sale in such public ga
zettes as may be designated by the Executive, that said
commissioners shall offer said lands for sale at the mini
mum price now established by law, to the highest bidder,
and keep a book or books in which shall be registered ihe
ungranted lots, and the names of the highest bidders, with
the amount of their bids; and upon payment of the money,
he or they shall given certificate of ihe payment of the
purchaser, setting forth the number of the lot and the
amount of his hid, which said certificate shall he sufficient
authority for a grant to issue to the purchaser, except in the
case hereinbefore provided. And it payment is not made
on the day of sale, ihe lot may ho resold; which fact shall
be noted in Ihe commissioners’ register, and also in the cer
tificate given to the second purchaser.
Sec. 5. And he it further enacted by the authority afore
said, That said commissioners shall make a return ol their
proceedings under the provisions of this act, and pay over
lo the Treasury the amount of money collected by them on
or before the first Monday in November, eighteen hundred
and forty-three; and the Governor shall Lane his warrant
on the Treasurer in favor of said commissioners for such
amount as he may deem reasonable and just for the time
they were employed and Ihe responsibility imposed upon
them. .
Sec. 6. And be it further enacted by the authority afore
said, That from and immediately after the passage of this
act. any person applying to take out any grant in the above
described counties, shall lake an oath that lie is the proper
owner of said lot, or the lawful agent of the owner thereof,
and .shall produce a power of attorney from the owner of
said lot, properly hi teste*’: Provided, that any judgment
credit* r. or the attorney of a judgment creditor, residing out
of the Slate, may lake out such grant upon making and fil
ing his or her affidavit, that he or she is a judgment credi
tor of the drawer, and applies for the grant for the purpose
of selling the said lot under his or her execution.
Sec. 7. And l>e it further enacted hy the authority afore
said, That the money nri>ing from the sales and grants of
the lands embraced in this act shall be paid into the Irea-
surv of this State.
Sec. 8. And be it further enacted hy the authority afore
said, That it shall he the duty of tha Gove* nor to cause the
publication of this law immediately after its passage, in two
or more of the papers in Milledgeville, and for as long a
period as ho may deem necessary to give it general publicity.
Sec. 9. And Ik? it further enacted hy the authority afore
said, That when any person may have had lands surveyed
on head rights, and the time may have relapsed for taking
out the grants, such persons shall be entiiled to receive
their grants upon the payment of the usual fees: Provided,
the same h .s not been granted to some other person.
Sec. 10. And he it further enacted by the authority afore
said, That all laws and parts of laws militating against this
act, be and the same are hereby repealed.

tractor under the direction of the Department.
6. In all cases, there is to be a forfeiture of the pay of the trip,
when the trip is m>t run; a forfeiture of nl: least c*oe-fourth part
of it, when the running or arrival is so for behind time as to lose
the connection with a depending mail; and a forfeitiue of a due
proportion of it, when a grade of service is rendered inferior tu
that in the contract. These forfeitures may 1* increased into
penalties of higher amount according to the nature or Irequsucy
of the failure and the importance of the mail. . . .
7. Fines will be imposed, unless the delinquency be satisfacto
rily explained in due time, for tailiog to take fr<uu or deliver ata
post office, the mail, or any part of it; for suffT* r»ag it to lie wet,
injured, lost or destroyed; for coaveying it in a place or manner
that exp »ses it t» depredation, loss or injury; for refusing alter
demand to convey a mail by any coach, railroad car or steamboat,
which the contractor regularly runs oa the route, beyond the spe
cified number of tiipsia the contract; aad for oot arriving at the
time set. And for settingup or running an express to transmit
commercial intelligence In advance of the mail, a penalty will be
exacted equal to a quarter’s pay.
8. The Postmaster General may annul the contract for repeated
failures; for violating the Po^t Office laws; for disobeying the
instructions of the Dermrtment; for refusing to discharge a car
rier w lien required by the Department; for assign fag the contract
without the consent of Ihe Postmaster General, or for setting op
or running nn express as aforesaid. , .
The Postmaster General may alter the contract, and alter the
schedule, he allowing a pro rata increase of compensation, witbra
the restrictions imposed by law. for the additional service
red,or for increased speed, if the employment of additional stock
or carriers is rendered necessary, but the contractor may, in sock
case, relinquish the contract, on timely notice, if he prelers it to
the change. He may aiso discontinue or ctrfail the icrxiff, be al
lowing one month’s extra pay on the amount dispensed with.
10. The payments will be made through drafts oa post omcef or
otherwise, after the expiration of each quarter, say in February
May, A a gust, and November. . t
II. The distances are given according to the best information
bat no increased pay will be allowed, should they prove to be
greater than is advertised, if the places are correctly named.
12. The Postmaster General if prohibited by law from know mg-
ly making a contract for the transportation of the mail with any
person who shall have entered into any combination, or proposed
to eater into any combination, to prevent the making of any bid for
a mail contract by any other person or persons, or who shall have
made any agreement, or shall have given or performed, or promis
ed to giveor perform,any consideration to do, or not to do. any
thing whatever, to induceany other person not to bid for a mail
contract.
13. Oa coa<*h routes where the present contractor shall be super
seded by an underbidder, who may not have the stage property re
quisite tor the pefurmaneeof the contract, he shall purr base from
the present contractor such of bis coaches, teams, and harness be
longing to the muteasshali be needed, nml may be suitable for the
service, at a fair valuation; and make payment therefor by reason
able instalments, as his pay becomes due, unless the present con
tra r tor shall continue to run stages on the route Should they not
agree as to ti e suitableness of the property, the terms, or the secu
rity, each may choose a person who may appoint a third, and their
decision shall be final; or the Postmaster General" will name the
umpire. Should the underbidder fall to comply, bis bid will be
offered to the contractor; but should he decline it, the propo. als of
the underbidder will be accepted unconditionally. The underbid
der should give early notice of his intention to fake or not to take
the stock, nml if the latter, of his reasons; and the present con
tractor is to defermine, on the first application, whether he will
sell it or not. ... . . .
14. A bid received after time, to wit: the 13th April next, at 2
pm, or without the guarantee required by law; or that combines
several routes in one sum of compensation, cannot be considered
ia competition with a regular proposal, not adjudged to be extrav
agant.
15. A bidder may offer on coach, rail-road, or steam-boat route*,
where that transportation is difficult or impracticable at cettaia
seasons, to sub«t'tute horse or wagon conveyance,or to intermit
service,a specified number of days, weeks, or months. He may
propose to omit an office that is inaccessible* or is not on the stage
road, the railway, or ata steam-lioat landing, as the case may be,
or he may offer t4» substitute an inferior mode of supply iu such
cases. He may propose different days aad boars of departure aad
arrival, p-ovided no more running lime is asked, and it is obvioaa
that no mail connection or other public accommodation is prejudi
ced. He may ask for a specified number of days for more running
time to the trip at certain seasons of peculiarly bad roads. But be
yond these changes, a proposal for service different from the ad
vertisement will prevent its being considered In competition with
a regular bid, not set aside for e* trevngance; and where a bid con
tains any of the above alterations, their disadvantages will be esti
mated ia comparing it with other proposals.
16. There should be but one route bid lor in a proposal.
17. The route, the service, the yearly pay, the bidder's name and
residence, and the name ol each member of the firm, where a com
pany offers, should be distinctly stated.
18. The following is the form ol the guarantr which should be
filled, the first blank with the name of the guarantor, the *econd
with that ofihe bidder; and the third and fourth with the l»egia-
ning and terminating points of the route; ami after being listed,
should be signed by the guarantor, who must be shown by the
written certificate of a postmaster, or other equally satisfactory
testimonial, to be a mss of property, and able to make good bra
guaranty. Thisgu .ranty.socertified, should accompany each bid:
“The undersigned guaranties that if his bid for ear-
