case, returnable to the term of this court in
JDecemhar next, and that 'Lewis J. Dugas, one
of the defendantH, resides without the limits of
the District of Georgia—It is ordered, that the
•aid Lewis J. Dugas do appear at the term of
this Court, to be holden at 8uvuunah, on the
fourteenth of December next, to answer to the
pluinlUlk on the merits of their said petition
*nd that a copy of this order be published in
one of the gazettes of this state for three

J CARVOCHAN and P. MITCH EL are sor-
• ry to be again brought before the public
by n second notice of Mr Clivistie’s, who has un
doubtedly claims against them, which, when
finally liquidated on the decision of the suit
now pending, they will try lo satisfy as soon ns
possible thereafter.
The deeds under which Mr Christie claims
an exclusive right to nil the real and personal
estate of Cirnochtnb MUchel, sre considered
as informal, unjust and illegal. Hence they
have been brought and are atili before the court,
and other deeds have been executed and re
corded, conveying the property for the use of
all their creditors, Mr Christio included, with*
out any trust or reservation beneficial to C. &
M. hr their families» and if this bo not agrecu-
hie to that gentleman, it must nevertheless ap-
pear ftiir and equitable to the public and all who
have a sense of justice.
The Trustees under the late deeds are anx
ions to sell the Lands in Florida, alluded to in
the notice of Mr (Jhriatie, and to apply the pro*
ceeds to the immediate payment of part or his
demand, and deposit a sufficiency thereof to co*
ver all his claim, subject to the decision of the
court—but his opposition to any reasonable sate,
as one interested in his own right, whilst injur
ing all parties concerned, must be borne until a
sale can be made under an order of court,
