man Lutheran Church at Ebcncier, stating
that the siod John Freyermuth on the fifteenth
day of Api'V., eighteen hundred £i fifteen, mort
gaged by deed under seal to the petitioners, all
those tracts of land, containing three hundred
acres in Effingham county, state aforesaid, on a

date January IV, 1823.
Whereupon resolved, That tho communica-
lion from tne Medical Society of this city in re
lation to the act of the last Legislature for the
suppression of Quackery, be received, and that
the same be published, as is required by law, in
all the gsxettcs of this city.

AN ACT
To establish a tribunal to enquire Into the qual
ifications of persons claiming to practice Me-
die.inr, Surgery, and Midwifery, within the
city orSavannan, and to grant certificates to
the tame, if found pioperly qualified.
Whereas, it appears by a memorial of the
Mayor and Aldermen of tho city of Savannah,
that the good people oFsald city, ami especialh
the poor and tyrterste people thereof have suf
fered heretofore much evil from the want of
proper lawa to regulate the vrxe.tice of modi
cirt*. surgery, amlnddw fery therein, the cor
sequence ol which want has been the imliacrl*
inmate and arrogant pretentions and undertak
ings of many unlearned and empirical persons
to prsctice therein in the said arts: And where
as, sound policy and a j roper regard for the
healths ana lives of the cuixensofa commercial
populous, and growing city, require that the le-
S 'slat nre should guard against such ancvilfor
e future:
$ 1. Bo it therefore enacted, by the Senate
and House of Representatives or the state of
Georgia, in general assembly met, and it ii
hereby enacted bv the authority of the same.
That the Georgia Wdical Society, established
in the city of Savannah, ahull be invested with,
and possessed with full power and authority to
examine, enquire into, Investigate, and deter
mine on the prnfeaiio'val qualifications, attain
ments and r.npncities'bf all ami every person or
persons claiming to practice within the limits ol
the said city in the said arts of medicine, surgery
and midwifery, or in any two or one of them,
and to grunt certificates of qualification under
the common seal cf the said society, or, if there
be no common seal, under the signs manual of
heir president and secretary, to him, her, or
them so claiming ami making appl nation there
for, if by a ma jority of said society, he, she, or
they shall he deemed dul> learned and qualifi
ed. And it shall be the duty of the members of
the said society, when application shall he made
hy any person or persons, for his, her or tfieig
•xammution to the end aforesaid, to convene at
Imir customary place of meeting, and to decide
toon the applicant's petition, within ten duyi
afterthey shall have been summoned to convene
by their pfi sident, or In his absence, sickness,
or other inability, by the person or persons dis-
charging his duties, op if there he not any such
person or persons, after they shall have been
summoned hy their secretary. Ami it shall be
the duty of the said president, person or per
sons performing his duties, to secretary, to sum
man each and every member of the said societj,
by a written citation, expressing the object of

And provided also, that in their examination,
the'said society shall he restricted and confined
to the investigation of professional attainments
and capacity alone, without regaYtl to any for
mer or present professional or moral reputation,

that any applicant should have obtained a diplo

should have stud ed thereat, or elsewhere.
$ 3. And he it furthet' enacted, by the author
ity aforesaid, That if, after application shall

of the county of Uhtlham, upon the petition of
the party iqjured, setting forth any such failure
or violation, and supported by his Affidavit of
the truth of such petition, to grant, as i
matter of right, a w rit of scire fac aa, direct
ed to tho president and membem of the suul
society, requiring the said society to shew
cause at the next term of the said court,
why their charter or act of incorporation should
not be deemed forfeited. A copy of this writ
and ofilhe petition shall be served upon the
.) resident or secretary, and if the allegations be
denied, an issue shall be joined, and the facts
be tried by aju>y emnannelled and sworn as in
othercases. W the allegations of tlie petition
be found to be tree, or if they he admitted, and
uo good cause be shewn, iUn.il be the duty of
the court to adjudge the charter foifeited, and
to order execution to issue for costa#goinst any

§4- Andbeit further enacted, hy the ncthor-

copartnership of uncrrtificated persons; and
such person shall be moreover liable to prose
cution by indictment in the court of common
pleus anu oyer and terminer-of said city, at the
instance oftjia mayor and aulermen of the said
city, or of unv common infoimer. Bands of pro-
seen ion shall be given as in othercases arising
under the nemd laws of'his thole ; if at the in-
stance ol the mayor and aldermen, tho bond
sliull he given by some person acting under
their sanction or authority, otherwise by the
common Inf miner; and upon the first convic
tion, the accused may be fined by the court in
> sum not exceeding one hundred donut's, ami
on each subsequent conviction, in a sum not ex
ceeding two hundred dollars, besides costs of
pruseention in each case; one half of the fines
sliall be paid into the treasury of the city of 8a-
vantuih, or to the common informer, and the
Oliver hall shall he equally divided between the
Union Society and the Female Asylum Society,
for the bemjfit of the orphans and children of
aaul societies.
§ 5. And be it further enacted hy the an-
thor.ty aforesaid, That no part «>f this act •hull
he so construed as to affect any person or per
sons now practicing, or claiming to practice in
the said city, in the said arts, or in any two or
one ot Idem, and now residing in the said city,
or who shall be engaged in the pructiceof the
same, or/>f any two or one of them therein, xm
nr before the first day of February next.
§ 6. And be it fumfer enacted by the author
ity'aforesaid. That if the Georgia Medical So.
ciety hliall communicate to the executive de*
part mem of this state, on or before the said
first day of February next, their acceptance of
this ant as an act additional to their charter,
ami that they are willing to be bound by its
condition* and requirement!, this act shall from
thenceforth commence In full and complete
operation, but otherwise shall be totally null
and void: And be it also enacted, Uiut tlio said
society shall, before the st»ld drat day of Febru-
ary, give notice of their said acceptance to the
mayor and aldermen of the said city of Savnn*
nuh, whose duty t shall he to make said accep
tance public by advertisement in all the pohln
gazettes of tlu said city, three times a week,
fol* the space of one calendar month.

until the first day of January, one thousand

I ^ltE author of the pieces which are to com-
. pose this volume, never anticipated fame or
profit; he merely followed the impulse of the
moment; and in no instance ever wrote, as a
task, any tiling contained in the proposed little
publication; no manuscript, anu few printed
copies were ever retained; and in many cases
these productions were forgotten by tlie author,
until recalled to his mind by »he public prints,
which have often gratified him by flattering
notice; but which have also frequently annoy
ed him hy mutilations, which were extremely
mortifying.
The lastcuisideration has inclined liim, dur
ing several years, to attempt the proposed col
lection, in order to correct the errors of others,
and res' upon his merit! or demerits.
Disinterestedness is not pretended; the au
thor confesses that a liberal patronage would
afford to him much pecuniary relief; and he is
be n-ore encouraged to expect this, from the
spontaneous notice, in the papers from Alaba
ma to Maine, of hia advertisement in the Ns-
tioivd Intelligencer, notifying In* intention.
The author confides in the tried seal of his
friends tin nughuut the Union, for the promotion
ol lus interest in this case; and trusts that such
as are so good ai to act aa agents, will look to
the responsibility and punctuality of subscrib
ers.
This volume will be peatly executed, and is
sue from thepr*-ss aasoon as possible, at the
price of One Dollar— with usual commission to
agents.
