Of tho Commiittoo on tlm Stato ofllio Re
public, accompanied with a Bill, to ho enti
tled an Act, to prevent the exocrcise of as
sumed and arbitrary power by all persons,
under pretext of authority from the Cherokee
Indians nnd other Laws.
The Committee on the Slate ofllio Repub
lic, to whom was referred so much of the
Governor’s Message ns relates to the Chero
kee government.
REPORT.
The propriety of effecting an entire aboli
lion of tho exorcise of governmental powers
by the Cherokee Indians, your committee
consider as settled—The State by an act of
her Legislature lias extended her laws both
civil nnd criminal over the territory and per
sons of said nation indiscriminately, and
thereby virtually abolished all government
over such territory, save her own—And any
further legislation, having for its object the
prevention oftbo exercise of sovereign pow
er by the Indians, would have boon rendered
by such act unnecessary, had any or sufficient
puins and penalties been annexed to the en
forcement of Indian laws or regulations.—
Those who claim tho right of managing tho
affairs of the Indians, having availed them
selves of such omission on tho part of tho
Legislature, nml continued to assemble hi
council from time to time, for the purpose
of making now laws and enforcing them and
others already adopted, on said tribe, have
rendered it necessary, in the opinion of your
committee, to enact such laws as will pre
vent in future the exerciso of such assumed
powers. Tho government of Georgia, or the
Cherokee Nation, alono lias tho undoubted
right of jurisdiction over the territory nnd per
sons of said nution, within tho chartered lim
its of Georgia. Both cannot possess it—and
if such a coequal right could exist, the oxer-
ciso of such right by both powers, would bo
cruelty in the extremo to the Indians.—
What would bo required by the one authori
ty, might bo rendered highly penal by the
other. The same not being declared crimi
nal by both ; would inflict some punishment
twice for the same offence—A state of things
not to be desired by any civilized community.
Such, however, is now the situation of tho
Chorokoo Indians, they live exposed lo tho
penalties and requisitions of two cod 's ema
nating from sources different in their origin,
different in thoir principles, and different in
their exactions. In determining winch pow-
or should yield in this contest for jurisdiction,
attempts to grasp a power jvliich the Con

great storm of Inst week, as verifying the
fad, so contrary to superficial signs, that the
violent storms, of tho description usually
termed North-Easters, are bred in the oppo
site quarter of tho compass. Tho Storm be
gan in this city on Monday, at 7 o’clock, IV
M. as our renders recollect, and their atten
tion was first directed to it liv vivid lightning
and loud thunder, followed by snow. At
Fayetteville, in North Carolina, more than
. i three hundred miles South of us, it began
three hours earlier, that is, at. 4 P. M. and in
that proportion earlier ns fur South as wo
have heard. To the North of us it began
later and later, in proportion to iU distance
from this point. By the following paragraph
it will bo seen that it began about oneb’clock
on Tuesday, at Boston, that is, six hours In
ter than here. At Portland, further North,
it began at two o’clock—one hour later.

which was adopted and ordered to be sent to
the Sonnte for concurrence.
Unsolved, That our Senators in Congress

quired, to ttso thoir heat exertions,.to procure
such n revision nnd reduction of tho existing
Tariff duties of the United States, ns will on
tho payment and discharge of the National
Debt, reduce tho same to the standard of ne
cessary revenue, and tho encouragement of
such domestic manufactures alone, as are in-
dispensable- to our national independence.
Resolved, That, the Secretary of State fur
nish to each of our Senators and Represen
tatives in Congress, a copy of tiio foregoing
preamble and resolution.

A small lot, brought to market by Mr. James Pink-
nrd ofMonroo county, sold yesterday at 8 rents. Thi*
high price was obtained o«ing to tho excellent quality
orthe article, and the extreme care which had been
used in preparing it for market. With the same ntu n-
tion other planters might get equal prices for their pro
duce.

Boats and Hats have left this week for Darien, with Cot
ton, and two or three arrived with goods.
Charleston, .Decembers.—Cotton—Tho business of
tho present w ek in Upland has been more limited than
the last. The sales amount to between 2000 ami 3000
bales, with no alteration ofprices. The transactions of
tho week in new comprise fair to fine lots from 8 1-2 to
9 3-8, chit fly at 9 1-4 for good parcels. N >ne but
choice lots bring 9 3-8. Thp quantity received is still
very Small, and the good and fine lots are taken out of
market as soon as they arrive. About 200 bales nf the
old crop have sold from 6 to 8 1-2 cents. Sam par
cels of new Santee haves Id from 17 to 18cents, for
the French market, and a few bag* common Sen Is-
l and af the new crop at 20 cents. Several lots have
been disposed of, being choice marks, nt priori which
have not transpired. Tho stock on ship-hoard not

first part of the week, but the market has since become
