senate so to act on the case of Seni-
tor Apostle Reed Smoot as to serve
notice on the polygamous head of this
church and his apostles that they
must live within the law; and there
should be an amendment to our con
stitution wide enough in its scope to
place plural marriage and political
control of the church entirely out of
the realm of possibility.”
Senator Dubois said, in part:
“The president of the Mormon
church and more than one-half the
apostles are openly living In polyga
my today. The political strength of
this organization has vastly increased
until now, in addition to absolutely
controlling Utah, they hold the bal
ance of power in Idaho and Wyoming
and are spreading over and threaten
ing Oregon and Nevada, and have a
following of no inconsiderable Import
ance in other Western states. Their
great aim is political power, so as to
protect them in their polygamous
practices. It is impossible now to
elect a senator from Utah, Idaho or
Wyoming who will openly oppose the
methods or practices of the govern
ing power of the Mormon church.
“The political power in this church
is becoming so great that it is not
confined to our Western states, where
they live, but I fear is becoming the
object of solicitude to the great na
tional parties.
The Mormon hierarchy hopes to
have an ally In the Republican party.
It would please them equally to have
the Democratic party as their ally
and to give the Democratic party their
support If the Democratic party were
In power.”
In conclusion, the senator made a
complimentary allusion to the Mor
mon people—the followers, as he call
ed them—and said the most of them
practice the virtues of industry, thrift
and honesty, and, outside of polyga
my, personal virtue.

Curious Freight Charges.
Some things revealed In the discus
sion of freight charges are curious
enough. For example, the rate on
cotton piece goods from Now York
to San Francisco by rail Is $1 per 100.
The rate from Chicago to Salt Lako
for tho some goods is 32.60 per 100,
and tho rate from Chicago to Denver
is 91.75 per 100. The goods which go
from New York to 8an Francisco go
over the same line, and on the same
train, for $1 per 100, while the same
class of goods on that train is charg
ed from Chicago to Salt Lake City at
92.50 per 100. The rato from New
York to San Francisco on canned
goods la 91 per 100, and from Chicago
and Reno, Nov., Is 31.76 per 100. Tho
rate on flrbt class treght from Naw
York to San Francisco Is 93 per 100,
and from Chicago to Salt Lake City,
93.10 per 100.

tenced to serve six months in Jail for
keeping a gaming honse. Tho gover
nor was asked to suspend sentence,
but refused to do so, on the ground
that there was no application pending
before the prison commission for cle
mency. However, he asked Attorney
Cooper to send In his application, and
stated that he would then pass on the
case. The application made only the
point that the fine was excessive,
which, if true, was an entirely Judi
cial question. In view of other fines
in similar cases, however, tho gover
nor did not consider the fine exces
sive. He refused then to suspend the
sentence.
Attorney Cooper, in a statement
published today, attacks tho governor
for not giving his client an opportu
nity to be heard before the prison
commission. There Is no requirement
in the law that sucb bearing shall be
given. The prison commission was
creatod as a pardon board, Blmply to
recommend, and the law creating it
took away none of the governor’s
right to originally consider and pass
on any question of executive clemen-

Court Stops Tax Execution.
Judge J. H. Lumpkin, of the supe
rior court at Atlanta signed a tempor
ary restraining order, enjoining
Comptroller-General Wm. A. Wright
and Sheriff John W. Nelms, of Ful
ton county, from proceeding any fur
ther In an effort to collect 9125,000
taxes from the Georgia Railway and
Banking' Company.
The petition follows the levy made
recently by Sheriff Nelms upon tho
freight depot of the Georgia road and
three acree of land In the heart of At
lanta to satisfy twenty-two tax execu
tions rendered by Comptroller-Gener
al Wright for back taxes on 15,000
shares of tbs stock of the Western
Railway of Alabama, said to be owned
by the Georgia road.
The comptroller-general and sheriff
are prevented from carrying out the
executon of the tax fl. fas. The case
Is sot for a hearing March 18.
