Section 1. Be it enacted by the Senate and House of
Representatives of the State of Georgia, in General
Assembly met, aud tits hereby enacted ou the same. That
from and immediately afiet this act shall have passed in
conformity with the Constitution of this State, it shall and
may be lawful for all Major Generals, and Brigadier Gene
rals, to be elected by t he people ol the respective Divisions
or Brigades, and all persons subject to do miliiia duty, shall
be entitled to vote for the same only.
Sec. 2. And Lett further enacted by the authority
aforesaid. That all laws and parts ofla-.vs, militating a-
gainst this act, be and the same are hereby repealed.

siding in different counties the suit may be brought in
either county, and a copy of ihe petition and process, ser
ved on the party residingout of the county, in which tiiq
suit may be commenced, shall be deemed sufiicientservice
under such rules and regulations as the Legislature have
or may direct:
And Whereas, by the existing laws of this State, the ma
ker ind indorser# of promissory notes, reshlingin tha
sami county, may be sued together in the same action,
but when they reside in different counties, it has been ru
led by the courts, that they cannot be joined upon the
groand that they are not joint obligors, nor joint promis
sory in the sense and meaning of the above recited clause
of tlie Constitution, and therefore in such cases, parties
are compelled to bring separate actions at a great increase
of.ostsand expenses, both to the plaintiff aud defendant#:
And Whereas, the said first section of the third anicla
requires amendment:
Be it enacted by the Senate and House of Representa
tives of the State of Georgia, tn General Assembly met,
