senatorial district, which district shall he composed of two
contiguous counties, not including die county with the Iar-
gest'representaiive population, which shall constitute a se
parate district; which district shall be arranged and organi
sed by the General Assembly, at the session when this shall
b.e adopted, and if any new county shall be hereafter lm -
vied, i: shalljbe annexed to one of the districts from which
it was* lalien; aud that in lieu of the seventh section of the
first article of the Constitution, the following shall he adop
ted; the House of representatives shall be composed of on*

Representatives of the Stale of Georgia, in General
Asse.nbly met, aud it is hereby enacted iy the same, That
from and immediately afyer this act shall have passed in
conformity with tfie .Constitution of this State, it shall ami
may be lawful for all Major Generals, aud Brigadier Gene
rals, to be elected b$ tbe people ol the respective Divisions
or Brigades, and all persons subject to do militia duty, shall
be entitled to vote for the same only.
Sec. 2. And be it further enacted ly the authority
aforesaid. That all Jaws and parts of Jaws, militating a'
gainst this act, be and the same are hereby xepealed. * '

Whereas, the above section'amongst'other things, provi
des that in case ofjoint'ubfigors, or joint prqfiiissors, re
siding in different counties the suit may* be brought in
ehber county, and a copy of the petition and prore - s ser
ved on.the party residing out of the county, in which the
suit may be commenced, shallbe deemed suiTIcientservice
under such rules and regulations as the Legislature hav«
or may direct;
And Whereas, by the existing laws of this State, the ma
ker and indorsers of promissory notes, residing in the
same county, may be sued together in the same action,
but when they reside lo different counties, it has been ru
led by the courts, that they cannot be joined upon the
ground that they are not joint obligors, nor joint prOnm-
sors, in the sense arid .meaning of tbe above recited clause
of.ihe Constitution, and therefore in such cases, parties
are compelled to bring separate actions at a greaUncreaae
of costs and expenses, both to the plaintiff and defendant#*:
And Whereas, the said first section of the third aiicle
requires amendment:
Be it enacted by the Senate and House of Representa
tives of the State of Georgia, in General Assembly met,
and it is hereby enacted ly the authojity of the same.
That so soon as this act shall have passed sgrieauly to the
requisitions ofihe Constitution, the following shall form a
part of the said first section, of the third article of the Con
stitution of this Statp.nn 1 to be inserted therein inmediote*-
ly after the clause above recited,to wit. And in case of a
make* and indorser, or indorsers of promissory notes resi
ding in different counties in this State, the same may b«
sued in the county where the maker resides and a copy of
the petition and process served on the indorser,or imior
sers, residing out of the county, in which tbe suit mav be
