Whkrkas, the third section of the first article of the Con
stitution of this State declares lhai the Senate shall be e-
lccted biennially, *»n the first Monday in ^iovemLer, un*
til auch day of t lection be altered by law; and shall be
composed of one member from each county, to be chosen
by the electors thereof:
And Whereas.the seventh section of thefirsr articljp of
the Constitution of this fitate decla-es, that tbe house of
Representatives shall be composed of members from all
the counties which now are or heteatier may bp inclu
ded withiu this 8tate, according to their respective num
ber of frjsp white persons, and including tkjrpe fifths of the
people ol color; the at tual enumeration &ha]l be made
within two years, and withiu every subsequent teim of
seven yearp thereafter, at such time and in aueb manner
as this convention may direct. Each county containing
three thousand pers*mj. agreeably to the foregoing plan
of enumeration, shall be entitled to two members; sevop
thousand, to three members*, fjnd twelve thousand to four
members; but et*ch county shall hr ve at ieaft or»e, and
not more than four members; the rcprasentativesahali be
chosen annually on the firs* Monday in November, until
»uch day of election be altered by law. Until the afore

people to elect the General Militia officers of this i?pate.
Section 1. Be it enacted by the Senate and House cf
Representatives of the Stale of Georgia, in General
Asst.ably met } and it is hereby enacted by the tame, That
from and immediately aftei this act shall have passed io
conformity with the Constitution of this State, it 6hall and
may be lawful for all Major Generals, and Brigadier Gene
rals, to be elected by the people ot the respective Divisions
or Brigades, and all persona subject to do militia duty, shall
ibe entitled to vote for the same only.
Sk.c. 2. And be it further enacted by the authority
aforesaid. That all laws and parts of laws, militating aj
gainst this set, be and the same are hereby repealed. *

Whereas, the above section amongst other things, provi
des that in case ofjoint obligors, or joint promisor#, re
siding in different counties, the suit may be brought ia
either county, and a eopy of the petition and process, ser
ved on the party residing out of the county, in which tha
suit may be commenced, shall bedeemed sufficienmcrvic*
under such rules and regulations as the Legislature have
or may direct:
And W hereas, by the existing laws of this State, the ma
ker and indorsers of promissory note*, resecting ia the
same county, may be sujed t« gether inthe same action,
but when they reside in different counties, it has been ru
led by the courts, that they cannot be joined upon the
ground that they are not joint .obligors, nor joint promi
sors, in U\e sense and meaning of the above recited clause
of the Constitution, and therefore in such cases, parties
are compelled to bring separate actions ht a great increase
