from and immediately after this ect shall have passed in
conformity w ith the Constitution of this State, it shall and
may be lawful for all Major Generals, and Brigadier Gene
ral*. to be elected by t lie people ol the respective Division*
or Brigades, and ail persons aubject to do tnililiadutv, shall
be entitled to vote for the same only.
Sec. 2. And beit further enacted ly the authority
aforesaid. That all laws and parts eflaws. militating aj
gainst this act, be and tbe same are hereby repealed.

Whereas, the above section amongst other things, provi
des that in "ase ofjoint obligors, or joint promissors, re
siding in different counties the suit may be brought iq
either county, and a aopy of the petition and process, ser
ved on the pany residing out of the county, in which the
suit may be commenced, shall be deemed sufficientservice
under such rules aud regulaiioa* aa tlie Legislature have
or may direct:
And Whereas, by the existing laws afthis State, the ma
ker and indorser* of promissory notes, residing in tha
same rounty, may be sued together in the same action,
but when they reside in different counties, it has been ru
led by the courts, that they cannot be joined upon tha
ground that they ate not joint obligors, r.or joint premia-
stirs, in the sense and meaning of the above recited clausa
of tbe Constitution, and therefore in such cases, parties
are compelled to bring separate actions nt a greatincreas*
of costs and expense*, both to the plaintiff'and defendant*:
