Whereas, the third section of the first article ofthe Con
stitution of this State declares tliai the Senate shall le e-
lected biennially, on the first Monday in November, t-n-

composed of one member from each county, to be chosen
by the elertors thereof:
And Whereas, the seventh section of the first article of
the Constitution oftliis State declares, that the House uf
Representatives shall be composed ot members from ell
the counties which now are or hereafter may be inclu
ded within this State, according to their respective num
ber of free white persons, and including three-fifths of the
people ofcolor; the at tual enumeration shall be tuad*
within two years, aud w ithin every subsequent term of
seven years thereafter, ot such time ami in such manner
as this convention tnay direct. Each county rontainitg
three thousand persons, agreeably to the foregoing p’tm
of enumeration, shell be entitled to two members; seven
thousand, to three members; and twelve thousand to fox r
members; but each county shall hive at least one, and
not mure than four members; the rvpresentativesshalll •
chosen annually on the first Monday in November, until
ouch day of ejection be altered by Jaw. Until the afore
said enumeration shall be made, the several corn tie#
shall be entitled to the following number of representa
tives, respectfully:— Camden,2; Glynn, 2; Liberty. 3;
McIntosh. S; Bryan, 1; Chatham, 4; Ellinghoui. 2; Stri
ven. 2; Montgomery, 2; Burke,3; Bulloch, I; Jefferson,
3; Lincoln, 2; Kiln t, 3; Jackson, 2; Richmond, 3;
Wilkes, 4; Columbia, 3; Warren, 3; Washington, 3;
Hancock, 4; Greene, 3; Oglethorpe, 3; and Franklin, 2t
And Whehsas, the said recited sections require alteratiott
—to th? end, therefore, that said sections may be altered:
Section 1. Be it enacted by the Senate and House
of Representatives of the State'if George a, in General
Assembly met, and it is hereby enacted by the authority
of the seme. That as soon as tins bill shall be passed, agree
ably to the requirements of Constitution, the following shall
be adopted in lieu of the sections above recited, to wit: iu
lieu of the third section of the first article of the Constitu
tion aforesaid, the Senate shall be elected biennially on tli*
first Monday in October, and shall consist of forty seven
members, and shall be composed of one member frtrn each
senatorial district, which district shall he composed of two

Section 1. Be it enacted by the Senate at.d Hov:e cf
Representatives tf the State tf Georgia, in Gene) al
Assembly met. and it is hereby enacted ly the some. That
from ana immediately after this act shall have passed in
conformity with the Constitution of this State, it shall and
may belawfulforall Mejor Generals, and Brigadier Gene
rals, to be elected by the people ol the respective Division*
or Brigades, and all persons subject to do militia duty, shall
be entitled to vote for the same only.
Sec. 2. And be it further enacted by the authority
aforesaid. That all laws anu parts oflaws. militating a)
gainst this act, be and the same are hereby repealed. -

same county, may he sued together in the same action,
but when they reside in different counties, it has been ru
led by tlte courts, that they cannot be joined upon tit*

a >rs, in the sense and meaning of the above recited clausa
of the Constitution, and therefor* in such cases, parties
are compelled to bring separate actions at a great ini tras#
