Whekkas, Official information has been received
atthis Department that a murder was committed in
the county of Early on the 26th day of June, 1S69,
upon the body of John Colly, (freedman) by Bob Hart,
alias Bob Sheba, alias Bob Battle, (freedman) and
that said Bart, alias Sheba, alias Battle has fled from
justice.
I have thought proper, therefore, to issue this, my
proclamation, hereby offering a reward of Two Hun
dred Dollars for the apprehension and delivery of the
said Hart, alias Sheha, alias Battle, with evidence
sufficient to convict, to tho Sheriff of said connty and
State. '
And I do moreover charge and require all officers
in this State, civil and military, to be vigilant in en
deavoring to apprehend tbe said Hart, alias Shena,
alias Battle, in order that he may be brought to trial
for the offence with which he stands charged.
Given under my hand and the great seal of the State,
at the Capitol in Atlanta, this 14th day of July, in
the year of onr Lord Eighteen Hundred and Sixty-
Nine, and of the Independence of the United States
of America, the Ninety-Fourth.

The said Hart, alias Sheba, alias Battle, is about 26
years of age, 5 feet II inches high. Epare built, quite
black, bad countenance, rather quick spoken, and
gives a sort of contemptuous toss of tbe head when
displeased, when pleased shows hi- upper teeth, not
by a broad smile bnt by an elevation of the upper lip,
higher at tbe outer edges than tbe middle. He is
best known in tbe community as Bob Sbeha.

upon the body of Eliza Taylor, by Daniel Martin,
and that said Martin has fled from justice.

said Martin, with proof sufficient to ‘ convict, to the
Sheriff of said connty and State.

held in and for the connty of Chatham, A. D„ 1869,
Henry Miller and Abraham Screven, were severally
tried for and convicted of the crime of burglary, ill
the night-time, and were then, and there, therefor,
sentenced, each, by the Judge presiding atsaid Court, y
to be imprisoned in the Penitentiary of this State for
and during the term of five years t and
Whereas, It appears from a careful examination of
the testimony adduced upon their several trials, that
the conviction was founded solely upon the insufficient
testimony of one Allen Williams, who testified only
as to having seen the accused near the place of the
burglary, in possession of property alleged to have
been stolen, and whose testimony fails,to w^blish .
the fact, that th9 accused entered, or broke into, the
sjoro from which tbe goods are alleged to have been
stolen; and ’ ' ’ v
Whereas. It further appears from saldteftimanyi
that the accused established >an alibi by the unim-
peaehed evidence of several witnesses; and : r.«V
Whereas, The said Allen Williams, upon whose evi
dence the accused were convicted, has, since their
conviction, made the following affidavit, to-wit:'
“STATE OF GEORGIA—Chateau Couhty.
“Before me, Robt. J. Wade, a Justice of the Peace
“in and for said county and State, personally come fi
“and appeared, Allen Williams, colored, of said oonn-
“ty, wire on oath saith, that.oa thel7th day of May,
"1869, at tbe May Term of the Superior Coart, Chet-
“ham county, he gave testimony as a witness for the.
“State against Henry Miller, colored, and Abraham
“Screven, colored, both tried and convieted of the
"offence of burglary. Deponent further saith, that
“the testimony which he gave on said trial, was not
“trne, but that he was compelled to give the same by
“threats, and nnder tbe punishment of being starved
“to death, for; that one William Wray, a detective
"officer of said city, did say to this deponent when he
“was arrested and imprisoned in the Police Barracks
“that he, deponent, must testify to the fact which be
"did give upon the trial of the said Miller and Screv-
"en, and upon failure so to do he, William Wray,
"wotiid starve him, and send him to the Penitentiary:
“and deponent farther saith, tt at he did not receive ;
“anything to eat for one day and a half; and onac-
’“connt of such treatmenthe was compelled to give the
'testimony which ho did; and deponent farther saith,
'that on the night of the alleged hnrglary he wag not
'with nor never saw the said Miller and Screven,
“and, therefore, does not know who committed the
“burglary; and deponent farther saith, that he comes
'‘before me and makes this affidavit voluntarily and
‘without being advised or threatened so to do; and
‘that he makes this affidavit because he feels he has
'done an injustice to the said Miller and Screven,
‘and therefore invokes upon a Just Providence to
“forgive him of one of the most unfortunate acta of
his life

And Whereas, It is made known to me, that a mo
tion for a new trial was made by tbe counsel for the
accused, upon the ground that the verdicts of the
juries before whom tbe causes were tried, were con
trary to evidence, and decidedly and strongly against
the weight of evidence, iu that said verdicts were not
sustained by the evidence elicited before said jaries,
the State having failed to prove the guilt of the ac
cused ; and that the Judge presiding at said conrt,
refused said application for new trials;
Now, Therefore, In consideration of the facts and
circumstances aforesaid, and to the end that Injustice
may not be done to the innocent and the guiltless
it is
Ordered, That tbe said Henry Miller and Abraham
Screven be, and they are hereby fully and freely par
doned ofthe crime o: which they stand conviefeffr
that they and each of them, be restored to their tfvtt
rights as citizens of this State, and that they be forth
with discharged and set at liberty.
