Upon the petition of Silas Holmes pray
ing the forclosuieofthe equity of redemp
tion of and in all that lot of land in the
City of Savannah known and distinguished
as pait of lot (no. number four, Trus
ses Garden and immediately north of Fort
Wayne, beginning south at a wall and in-
clud.nc the said wall, and running thence
northwardly to the river one hundred and
ninety ono feet, tiience Eastwardly along
tho river Savannah seventy-five feet,
thence southwardly one hundred and nine
ty one feet to the said wall, and including
the said Avail; thence along the said wall to
tile place of beginning: Leaving and re
serving always a passage or road sufficiently
wide for wagons and other carriages to
pass and repass with convenience through
the said lot from the wharf now used as a
Ferry wharf, with all and singular the iin
provements thereon, which lot of land dis
oribed am] hounded .as aforesaid with all
the improvements thereon was mortgaged
by Isaiah Devauport late of the County
and state aforesaid deceased,in his life time
to Abraham Richards of the city of New
York oy deed bearing date on the second
day of April Eighteen Hundred and Twen
ty Two to secure the payment of the sum
of two thousand two hundred Dollars in
two equal instalments, that is to say the
sum of eleven hundred dollars on the first
day of January one thousand eight huu
dred and twenty three, and the further
sum of eleven hundred dollars on the first
day of January one thousand eight hundred
and twenty four, with interest at eight per
cent per annum on the said ttvo thousand
two hundred dollars from the said fecund
day of April 18®? according to the condi
lion of a bond executed by the said Isaiah
Davanporl in bis lifetime to the said Abr’m
Richards, hearing even date with the said
nortgage, and it appearing that there was
lue on said bond the third day of Septcm
her 1821, the principal sum of one thou
sand and twelve dollars and ninety cents,
exclusive of interest thereon, which st ill
remains unpaid. And if also appearing
that the. said bond and mortgage with all
the right and interest of the said Abraham
Richards to the property in the said mort
gage described, were oil the socond day ol
February 1C28 assigned for n valuable con
siderntion to the said Silas Holmes by the
said Ahrahain Richards. On motion of
McAllister & Bulloch, Attorneys for the
petitioneis, it i s ordered {that the Heirs or
legal Representatives of the said Isaiah Do
vanport do pay into this Court within 12
months from this date the principal and
interest due on tho said bond aud the costs
if this application for foreclosing of the pre
uiises or in default theieof die equity of ro
dnmption of the said heirs and legal repre
sentatives of the said Isaiah Devnnport to
the said Mortgaged premises he thence
forih ani forevor foreclosed. And it is
further ordered lh.it a copy of this rule he
served on the heirs & legal representatives
of the said Isaiah Devanport at least six
months before tho time appointed for the
payment of said sum of money into Court,
or published in one of the G zettes of the
city of Savannah in said State once a
mouth for twelve months before the time
aforesaid, And that further and other pro
ceedings be had ns are prescribed by the
Statutes in such case made and provided.
