Upon the petition of Silas Holmes pray
ing the forclosuieofthe equity of redemp
tion of and in all that lot of land in the
City of Savannah known and distinguished
as pa it of lot (no. 4) number four, Trus
tees Garden and immediately north of Fort
Wayne, beginning south at a wall and in
cluding the said wall, and running thence
northwardly to the river one hundred and
ninety one feet, thenoe Eastwardly along
the river Savannah twenty-five feet,
thence southwardly one tainrired and nine
ty one feet to the said wall, and including
the snid wall; thence along the said wall to
the place of beginning: Leaving and re
serving always a passage or road sufficiently
wide for wagons and other carriages to
pass and repass with convenience through
the said lot from the wharf now used as a
Ferry wharf, with ail and singular the im
provements thereon, which lot of land dis
cribed and bounded as aforesaid with all
the improvements thereon was mortgaged
by Isaiah Dcvanport late of the County
and state aforesaid deceased,in his life time
to Abraham Richards of ihe city of New
York oy deed bearing date on tho second
day of April Eighteen Hundred andTiven
ty Two to secure the payment of the sum
of two thousand two hundred Dollars in
two equal instalments, that is to say the
sum of eleven hundred dollars on (he first
day of January one thousand eight hun
dred and twenty three, and the further
sumof eleven hundred dollars on the first
day of January one thousand eight hundred
and twenty four, with interest at eight per
cent per annum on the said two thousand
two hundred dollars from the said *econd
day of April 1821 according to the condi
tion of a bond executed by the said Isaiah
Devanportinhis lifetime to the said Abr'in
Richards, bearing even data with the snid
nortgage, and it appearing that there was
toe on said bond the third day of Scptcm
her 1824, tho principal sumof one thou
sand and twelve dollars and ninety cents,
exclusive of interest thereon, which still
remains unpaid. And it olso appearing
that the said boiy) and mortgage with all
the right and interest of the said Abraham
Richards to the property in the said mort
gago described, were on the second day ol
February 1828 assigned for n valuable con
sidcratiott to the said Silas Iln|m<£ by the
said Abraham Richards. On motion of
Mc\llister& Bulloch, Attorneys for the
oAtiiiouHis,' it is ordered {that the Heirs or
legal Representatives of the said Isaiah De
vanport do pay into this Cou. t within 12
months from this date the principal and
interest due on the said bond and the costs
>f this application for foreclosing of the pre
mises or in default thereof the equity of re
lemption of the said heirs and legal repre
sentatives of the said Isaiah Dcvanport to
the said Mortgaged premises he thence
forih an I foreve- foreclosed. And it is
further ordered that a copy of this rule be
served on the heirs & legal representatives
of tho said Isaiah Devanport at least six
months before tho time appointed for the
payment of said sum of money into Court,
or published in one of the Gazettes of the
city of Savannah in said State once a
month for twelve months before the time
aforesaid, And that further and other pro
ccedings be had as are prescribed by the
Statutes in such case made and provided,.

assignee of Ethan Clark, shewing
that Henry Sadler, late of Camden county,
deceased, in hi* life time, together with
Ray Sands, of same county, to wit: on the
12th day of February 1816, being indebted
to the said Ethan, in the sum of eighteen
tfiousandone hundred and eighty dollars
for which they jointly and severally exe
cuteri four promissory notes of said Ethan,
bearing said date, one of which was foi the
sum of four thousand two hundred dollars,
and payable 12th Feb. 1817, ouo other for
ihe sum of four thousand seven hundred \
ten dollars, payable 12lli Feb. 1818, one
other for four thousand four hundred and
ten dollars, payable 12th Feb. 1819, and
the 4th and Ust note payable on the Will
Feb, i Hfo, for the sum of four thousand
eight hundred and fifty dollars, together
making said sum of eighteen thousand one
hundred and eighty dollars—the belter to
secure the payment of which sum of money
the said Henry Hxdler, then in life, and
Ray Sands did on (he 12th day of Februa
ry, 1816, mortgaged to said Ethan, all
that tract or parcel of land on Crooked
Creek in said county, called Greenfield
plantation, containing twenty thicc hun
dred and ttfrnty five acres, more or less,
originally granted to Dr. David Oliphant,
beginning at a slake at Crooked Creek,
running south 89° west 155 chains by
land of John Clark and others, thence
south 1° east 150 chains to the land* of
James Moore, thence by the sani” land now
nr late of the estate of Samuel Brailsford,
thence by the some to the place of begin
ning—and also one undivided fifth purl of
a tract of land, situated on or near Bt Ma
rys river, in the county aforesaid railed
and known by the name of Catfish Tract,
containing in the whole aeven thousand
five hundred acre* more or less—and also
forty one negro slaves therein enumerated,
with tha C6.idllio.ki that the said money
should he agrt-esbfe the tesor of ;2id
notes, there set forth, paid, as they respec
tively become due. and providing that snid
mortgage should not I e loreclosed, until
the las* payment was due and unpaid, and
shewing that a part of »aid money, to wit :
eleven hundred and forty six dollars and
46 cents, besides interest from the 18th
day of January. remains un aid,and
praying the foreclosure of said mortgage
—and on motion it is ordered that thu le
cal representatives of the said Henry Sad
Jer, said Ray Sands all others having claim
to the said mortgaged pfemises do pay in
to (his court, the said sum of eleven hun
dred and forty six dollars 46 cents, and in
terest from the said 18ih Jan. 1826, and
the costs of this application, within twelve
months, otherwise that the equity of re
dominion of the said legal representatives
of the said Henry Sadler,and the said Ray
Sands, and of all other* claiming, or to
claim by them or under the said Henrv ~ad
let and Ray Sands, if. in, or to. the saul
mortgaged premise*, and to all and every
part thereof, be from henccfoith, and for
ever foreclosed.
And it is further ordeted that a copy of
this rule he published once a month for
twelve month*, previous to the time appoin
ted for the payment of said money, in one
of the gazettes of this Siate.
