assignee of F.than Clark, shewing
that Henry Sadler, late of Cainden coubty,
deceased, in his life time, together with
Ray Sands, of same county, to wit: on the
12th day of February 1816, being indebted
to the said Ethan, in the sunt of eighteen
thousand one hundred and eighty dollars
for which they jointly and severally eke
cuted four promissory notes of said Ethan,
bearing said da>e,one of which was fot the
sum of four thousand two hundred dollars,
and payable ijtth Feb. ISii, one other for
the sum of four thousand seven hundred &
ten dollars, payable l£th Feh. 1818, one
other for four thousand four hundred and
ten dollars, -payable 12th Feb. 1810, and
tho 4th and last note payable on the 12th
Feh. 1820, for the sum of four thousand
eight hundred and fifty dollars, together
making said sum of eighteen thousand one
hundred and eighty dollars—the better to
secure the payment of which sum of money
the said Henry Sadler, then io life, and
Ray Sands did on the ttlh day of Fehrua
ry, 1816, mortgaged \6 said Ethan, ail
that tract qy parcel of land on Crooked
Creek in sain county, called Greenfield
olanuthm, containing twenty three hun
dred and twenty five acres, more or loss,
originally granted to Dr. David Oliphant,
beginning at a stake at Crooked Creek,
running south 89° west 155 chains by
land of John Clark and others, thcnco
south 1° east 150 chains to the lands of
Janies Moore, thence by the same land now
nr late of tho estate of Samuel Brailsford,
thence by the same to the place of begin
ning—and also one undivided fifth part of
a tract of land, situated on. or near St Ma
rys river, in the county aforesaid called
Mini known by the name of Cmn>hTract,
containing in the whole seven thousand
five hundred acres more Or less—and also
forty one neero slaves therein enumerated,
with the conditions that the said monry
should be agreeable to the tenor of said
notol, there set forth, paid, as they respec
tively become due, and providing that said
mortgage should not he foreclosed, until
the last payment was due and unpaid, and
shewing that a part of said tnnnev, to wit :
eleven hundred and forty six dollars and
46 Cents, besides interest from the IRti
day of January. 18i8. remains «n aid,and
praying the foreclosure of said inn tgai.*
—and on motion it Is ordered that the le
gal representatives of the said Henry Sad
ler, said Ray Sands all others having claim
to the said mortgaged premises do pay in
to this court, the said sum of eleven hu-i
dred add forty six dollars 46 cents, and in
terest from the said 18th Jan. 1826, nn 1
the costs of this apulication. within twelve
jnonths, otherwise that the equity of re
demptionof the said legal representatives
of the said Henry Sadlrr.and the said Ray
Sands, and of all others claiming, or to
claim by th**m or undei the said Henry »-ad
ler and Ray Sards, if. in, or to, the said
mortgaged premises, and to all and eveiy
part thereof, be from heocefoith, and for
ever foreclosed.
4nd it is further ordered that a copy of
(hit rule be published once a month for
twelve months, previous to the time appoin
ted for the payment of said money, in ooe
of the gazettes of this State.
