has just been rendered by the Supreme
Court of Georgia, and Which defines

ever before the duties of an employer
with reference to the laws on the gar
nishment of wages.
In substance, the decision boldB that
If an employer who Is garnisheed for
a laborer’s wages which under the law
are' exempt, falls to set up this fact
ot exemption In hls answer and pays
the wages into court, the employer
will be liable in a suit by the laborer
for the recovery of these wages.
The specific case on which the de
cision referred to It based Is that ot
the Southern Railway Co., plaintiff In
error, vs. J. T. Fulford, defendant In
error, the Issue having been appealed
from the city court ot Macon. The
statement of the case as here present
ed Is taken from the Macon News;

Originally J. T. Fulford had been
sued In a Justice of the peace court
at Macon for the sum of $60. At the
same time the Southern Railway Co.
had In Its possession $49.36 In wageB
which Fulford bad earned as a switch
man In the employ of the railroad.
For this sum Fulford’s alleged credit
ors Issued against the Southern Rail
way Co. a summons ot garnishment.
In filing Its answer the railway com
pany admitted that- It owed Fulford
the amount named, but did not set up
the fact tbat these wages were, under
the garnishment laws, exempt; and
subsequently, moreover, paid the
amount into court This sum was ap-

plied In paying the costs of the court
five dollars of which had been incur
red by the railway company in an
swering the garnishment summons,
and the remainder turned over to the
plaintiffs creditor.
Just at this point begins the sig
nificance of the Supreme Court’s de
cision. For shortly afterward J. T.
Fulford Instituted In the city court ^
suit against the railroad company for
the recovery of hls $49.36 wages. At
that time the railroad contended that
It had already paid out these wages
to satisfy a claim In the justice court
and that since Fulford had not ap
peared at the hearing there to claim
the protection of the garnishment law,
the railroad company had been justi
fied and was not liable for recovery.
Attorney R. Douglass Feagin, how
ever, who represented Fujlford, de
murred that thlB was no answer In
law, and hlB demurrer being sustained
by the city court, a Judgment against
the railroad company tor $49.35 was
rendered.
The railway company Immediately
appealed to the Supreme Court of
Georgia, but the Judgment of the lower
court was sustained, and Fulford will
now recover hls wages.
The decision, which Is regarded as
one of singular Importance to laborers
and employers, reads In full as fdl-
lows:
“One who owes wages which are, ex
empt from garnishment, upon being
garnisheed, should set up the fact of
the exemption In hls answer; and it
he falls to do so and permits Judg
ment to be rendered Against himself
and then pays the money due for
wages Into court, he does so at hls
peril, and will be liable In a suit by
the laborer for the amount of the
wages." < < ,
