the said McDonald by his unnecessary,
wanton and reokless conduct causing
much disturbance and alarm among
the spectators and endangering the
lives of those present; and petitioner
alleges that the drawing of Bald pistol
as herein alleged was an unnecessary
wanton and reckless not, showing an
utteV disregard for human life.
Fifth—That the said W. W. McDon
ald, officer aB aforesaid, did, on the
day and date aforesaid, whllo on duty
as an officer for said city, without
provocation or just cause, unnecessar
ily and not In self-defense, draw his
pistol, which he carried about Ills per
son, and did point said pistol at and
threaten to shoot one Tim Kimbrough,
and with menaces and threats while
the said Kimbrough was. In his cus
tody did compel the said Kimbrough
to enter the' suld baseball park and
pay the entrance fee thereto contrary
to the desire and over the protest of
the said Kimbrough.
Sixth—Petitioner attaches hereto,
marked ‘‘Exhibit A,” a petition by tlio
citlzerts whose names are thereto sub
scribed, and asks that same may be
considered together with this his pe
tition.
Wherefore, the premises considered,
petitioner prays that the alleged wan
ton, reokless, unnecessary and Illegal
acts of the said W. W. MoDonald be
Inquired Into, and that, If after inves ;
tlgatton they.be found to be true, the
said McDonald be dismissed from the
position of a police officer In and for
the city of Albany, Georgia.

Atlanta, Ga., May 2.—This ’ month
the term of office of Hori. Hoke Smith,
and several other members of the
board of health of the city ol Atlanta,'
will expire, and there Is a rumor going
the rounds that council may not re-
elect*Mrl Smith because of the guber
natorial campaign. That a flifht will
be made on his candidacy for re-elec
tion Is certain, but whether or not it
will succeed remains to be seen.'

Elliott Muse brings this, his peti
tion, and alleges; (
First—That, he is a resident of the
city of Albany In said state and coun
ty.
Second—That W. W. McDonald Is,;
and at all tbe times hereinafter named;
was, a police officer hi the employ of
the said city of Albany, and Is and,
was regularly on duty as a police offi
cer of and for said city.
Third—That said W. W. McDonald,
officer as aforesaid, while on duty as
a police officer for said city at the
baseball park at Albany, Georgia, on
the 24th day of April, A. D. 1906; did
without just cause arrest one Walter
Muse, a 16-year-old boy, and while the
said Whiter Muse was In his custody
and control as his prisoner, the said
McDonald, officer as aforesaid, did,
without provocation or Jnst cause, un
necessarily, wantonly and maliciously
strike tbe said Walter Muse a severe
blow in tbe face with his clenched fist,
breaking tbe skin on the said Muse’s
face and bruising and blacking same,
said blow being stricken without prov
ocation, in the heat of passion, the
said Muse being then and there under
arrest in the charge of the said Mc
Donald, officer as aforesaid, and neith
er offering nor attempting to offer any
resistance whatever to said officer.
Fourth—That said W. W. McDonald,
officer as aforesaid, did, on the day
and date aforesaid, while on duty as
an officer for said city, without prov
ocation and not in a case of self-de’
tense, draw his. pistol which he carried
about his person, and pointing' the

a young man who tried ,to blow out his
brainB with a Winchester rifle as he
stood on a corner of Decatur street
Monday afternoon, died yesterday
afternoon in Grady hospital, where he
had been taken shortly after firing the
E^u at himself. The bullet pene
trated the young man’B brain. 1 None
of his relatives has been heard from.
