BY a joint resolution of the General As sembly, passed 18th December, 1835, it is provided, that the accounts for services ren j dered during the present year, (1835) in the counties of Steirart, I.ee, Baker, lianrlolpli, Sumter, Early, and the counties adpicent thereto, in defending and protecting the people from the hostile movements of the Creek In dians, shall be paid by the Governor, out of any funds in the Treasury, not otherwise appropria ted.” With a view to carry into eflect this re solve of the Legislature, notice is hereby given to persons having claims against the State tin der its provisions, to make out and transmit them to this department, properly authentica ted, on, or by the Eifst day of J/czy next. It is required that each claimant will make oath, before some magistrate, to the correctness of his claim, and also procure the certificate of the commanding ollicer of the county, under whose orders the services were performed, that the services chargedfor, were rendered as stated in the account. Be it enacted by the Senate and D ouse o f Hiprescntatii'cs of the State of (1 ear ful in General Assembly met, and it is hereby enacted by the. authority of the. same, That Irom and after the passatre oi this act, the sum of ten thousand dollars be,ant! the same is here by appropriated out of anv monies in the Cen tral Bank, for the improvement of the naviga tion ol f lint River, from Bainbridge in Decatur county, to the old agency in Crawford county, or to any point above that place, which the commissioners hereinafter appointed, shall de termine on. Sec. 2. And be it further enacted by the au thority of the. same, That Sanders Durham, I'rancis Bacon, Walter L. Campbell, John L. Shelby, Alexander Shotwell, Elijah Jones, Jolm W . And be. it further enacted by the authority of the same, That upon the receipts of the bonds of said commissioners executed ' 1 conformity to the above and foregoing ■-ection, and a certificate setting forth the contracts en tered into for the purpose of effecting said im provement, it shall be the duty ol his Excellen cy the Governor, to issue his warrant upon the Central Bank in favor of said Commissioner for one fourth of each contract entered into by per sons contracting to do said work. Sec. 4. And be it further enacted by the authority of the same, That the said Commis sioners ora majority of them, shall let out said improvement by contract, and may or shall promise to pay to said undertakers, the amount of one fourth w here the work is commenced, on fourth where the work shall by the commissioners be judged to be half finished,and the other tw o fourths where the work is completed ; Provi ded, the said undertaker shall on receiving the first payment give bond and security, payable to His Excellency the Governor, for the faithful performance of said work. Sec. 5. And be it further enacted by the authority of the same, That should any vacan cy occur in the Board of said Commissioners, by death, resignation or otherwise, it shall be the duty of the remaining commissioners, or a ma jority of them, to fill such vacancies when they may occur, and in all cases when new commissioners are so chosen, they shall comply with the requirements contained in the second section of this act. Sec. (i. And be it further enacted by the authority of the same, That it shall be the duty of the commissioners, to keep a fair journal and record of their proceedings, and report their ac tings and doings from time to time, to hisE.xcel | lency the Governor, and w henever they may be required by him, the progress of said work ; and on failure to do so when required aforesaid, they shall forfeit the per diem compensation hereinafter to be allowed, and it shall be the duty of his Excellency the Governor, to report to the next Legislature, all the information which he may receive from said commissioners relative to said work. Sec. 7. And be if enacted by the authority of the same, That each and every commissioner appointed as aforesaid, shall be entitled to compensation, and receive one dollar per day, for each and every day he shall attend to the su perintendence of said w ork, which the Gover- I nor is hereby authorized to pay out of the con | tingent fund, satisfactory evidences being ad duced to him, that the services have been ren dered as contemplated by this act ; Provided, that such term of service does not exceed twen ty live days per annum. Sec. 8. .1n.7 be it further enacted, That the sum ot twenty thousand dollars be, and the same is hereby appropriated for the improvement of the navigation of the Chattahoochee river from the Florida Line, to the city of Columbus, and for the purpose of removing the shoals and obstruc tions in the same ; and that the same shall be expended under the superintendence of the Commissioners to be appointed by his Excel lency the Governor, under the same rules and regulations, as are prescribed for the disburse ment of the funds set apart by this act, for the improvement of the Flint River. Sec. 9. And be it further enacted, That bis Excellency the Governor do draw from the I Central Bank, the money appropriated by this I act, in case there be not a sufficient fund in the Treasury to meet the same; Provided, nothing contained in the foregoing act or anv of the sec tions thereof, shall be so construed as to autho rize the Governor to draw his warrant in favor of any of the foregoing commissioners for the sum to be disbursed by them, until said Commis sioners report to his Excellency of the operations intended to be adopted by them, and the proba ble utility of such expenditure, and to make such report on the application for each instal ment of such appropriation ; and whenever his Excellency shall deem lite scheme visionary, or front the report made by the commissioneers that the expenditure would he useless, lie is harebv authorized to withhold his warrant, and lay the matter before the next Legislature. Sec. 10. And be it further enacted by the vthority of the same, That all laws and .- -is oflaws militating against this act, be, and the j same is hereby repealed. And be further enacted by the authority aforesaid, That if any person or per sons shall, at atty time after the passage of this act, obstruct by dams, ferries, or otherwise more than two thirds of said river within the above specified limits, it shall be the duty of said commissioners, forthwith to have all such obstructions speedily removed, and should such obstructions be again placed in said river the owner or owners of such dams or ferries so of fending, shall be subject to pay a fine, not e.x --! ceeding thirty dollars for every such offence, to I be collected in any court having competent ju- I risdiction of the same, one half to be paid to the | informer, and the other half to be paid into the I county treasury for county purposes. | Sec. 3.
