The Convention met pursuant to adjournment, and its delib- !
erations were opened by prayer from the Rev. Mr. Goulding. [
On motion of Mr. Berrien, of Burke, the Convention again re
solved itself into a Committee of ti.e Whole, Mr. Stocks in the
Chair, on the unfmi'hed business of yesterday, being the report
ofihe Committee of Thirty, to reduce and equalize the num
ber of members in the General Assembly of Georgia.

ed progress, asked and obtained leave to sit again.
Tne Convention then adjourned to 3 o’clock this afternoon.

The Convention met pursuant to adjournment.
On motion of Mr. Berrien of Chatham, the Convention again

The Convention met pursuant to adjournment, and its delib
erations opened with prayer by the Rev. Mr. Wilson.
O.i motion of Mr. Hull, the Convention again re-olved itself
into Committee of the Whole, Mr. Stocks in the Chair, on the
report of the Co mini teeofThirty, and having spent some time ■
therein, the C unmittee rose, asked and obtained leave to sit
again.
On motion of Mr. Springer, the Convention then adjourned
to 3 o’clock, this afternoon.

The Convention met pursuant to adjournment.
Mr. Crosby, a delegate from the county of Heard, appeared,
was qualified, and took his seat.
On motion of Mr. Gray, the Convention again went into I
Committee of the Whole, Mr. Stocks in the Chair, on the un- :
finished business of the forenoon, being the report of the Com
mittee of Thirty. Having spent some time therein, the Com
mittee rose, and the President having resumed the Chair, the
Chairman reported the report of the Committee of Thirty with
amendments, as follows:
The Committee of the Whole, to whom was referred the re
port of the Select Committee of Thirty, have had the same un
der consideration, and beg leave to report the same with amend
ments.
The House of Representatives shall be composed of members
from all the counties which now are, or hereafter may be in
cluded within this State, according to their respective numbers
of free while persons, and including three-fifths of all the peo
ple of color, to be ascertained by an actual enumeration, to be
made from time to time, at intervals of seven years, as now by
law provided. Each county shall be entitled to one member.
Each county having a representative population as above spe
cified, of six thousand persons, shall be entitled to one addi
tional member, and each county having such representative
population of twelve thousand persons, shall be entitled to two
additional members, but no county shall have more than three
members.
The number of members of which the House of Representa
tives will be composed according to the aforesaid ratio, and the
last census, shall not hereafter be increased, except when anew’
county is created: and it shall be the duly of the Legislature,
at their session, to be holder) next after the enumeration provi
ded lor by law, so to regulate the ratio of representation, as to
prevent such increase.
The Representatives shall be chosen annually, on the first
Monday of October, until such day of election shall be altered
by law.
1 he S -nat* shall consist offorty-six members, elected annu
ally on th<- first Monday in October, and shall be composed of
one member from each of the forty-six Senatorial Districts fol
lowing :

TUESDAY, May 14/A, 1839.
The Convention met agreeably to adjournment, and opened
with prayer from the Rev. Mr. Baker.
On motion of Mr. Stark,
The report of the Select Committee of Thirty, as amended
by the Committee of the Whole, was taken up.
Mr. Stark offered the following as a substitute fey the whole
report: , •
The ThiPd Section of the First Article of the Constitution
shall read as follows :
The Senate shall be elected annually, on the first Monday
in October, until such day shall be altered by law ; and shall be
composed of one member from each county, to be chosen by
the electors thereof.
The Seventh Section of the First Article shall read as follow s :
The House of Representatives shall be composed of members
from the following counties and representative districts, accord
ing to their respective nuinbersof free white persons and includ
ing three-fifths of all the people of colour ; to be ascertained by
actual enumeration to be made from time to time, at intervals
of seven years, as is now by law provided. Each county hav
ing a representative population as above specified, of four thou
sand, or upwards, shall be entitled to one member; of eight
thousand, to two members; of twelve thousand, to three mem
bers. No county shall have more than three members. And
until the next enumeration skall take place, the several counties
and representative districts shall be entitled to the following
number of representatives respectively :

Mr. Jones, of Muscogee, proposed to separate the counties
of Marion and Muscogee, so as to allow Marion one member,
and Muscogee three members in the representative branch of
the Legislature; which was accepted by the mover of the sub
stitute.
Mr. Stephens proposed to separate the counties of Taliaferro
and Greene, so as to allow Taliaferro one member and Greene
two ; which was likewise accepted.
Mr. Springer proposed to separate Carroll from Heard, so as
to allow those counties one member each ; which was also ac
cepted.
Mr. Spencer proposed to separate Liberty from Mclntosh,
so as to allow one member to each county ; which was also ac
cepted.
Mr. Patrick moved to lay the substitute on the table Ibr the
balance of the session.
Whereupon the yeas and nays were required to be recorded,
and are, yeas 140, nays 145.

Mr. Hunter then moved to strike out 8,000, and insert 6.000 ;

which was decided against striking out.
Mr, Fletcher moved to strike out 12,000, and insert 11 ,000.
as the ratio of representation for three members; when Mr.
Stephens moved for a division of the question, which was deci
ded against striking out.

So the motion was lost.
The Convention again engaged in debate on the substitute,
when the motion to adjourn was renewed and carried.
The Convention was adjourned to 3 o’clock, P. M.

Mr. Woflbrd proposed to Mr. Starke to strike out from his
substitute the words “and including three-fifths of all the peo
ple of colour,” which was accepted ; whereupon a question of
order was raised, viz: That Mr. Stark had not the right to
accept such amendment without the consent of the Convention,
and decided by the President to be in order. Air. Jenkins ap
pealed from the decision of the President, and the decision was
sustained by a vote of 143 to 132.
Mr. Jones, of Muscogee, moved that, after the words “ free
white persons,” in the fourth paragraph of the substitute, the
words “and including three-fifths of all the people of colour,”
be inserted ; whereupon the yeas and nays were required to be
recorded, and are, yeas 192, nays 83.

Mr. Haynes, of Hancock, offered the following as a substi
tute for the substitute of Mr. Stark, as modified:
The Senate shall consist of forty-six members, to be chosen
annually on the first Monday in October, until such day of elec
tion shall be altered by law.
Fite House of Representatives shall consist of members from
all the counties which now are, or hereafter may be organized
within this State, according to their respective numbers of free
white persons, and including three-fifths of all the people of
color; to be ascertained by actual enumeration, to be made
(torn time to time, at intervals of seven years, as now provided
by law, upon the following principles, to wit: Each county in
the State shall be entitled to one representative; each county
having a representative population, as above specified, of seven
thousand persons, shall be entitled to one additional member,
and each county having such representative population ol eleven
thousand persons, shall be entitled to two additional members ;
but no county shall have more than three members.
1 he number ot members of which the House of Representa
tives will be composed according to the aforesaid ratio, and the
last census, shall not hereafter be increased, except when a new
county is created : and it shall be the duly of the Legislature,
at their session, to be holdeii next after the enumeration provi
ded for by law, so to regulate the ratio of representation, as to
prevent such increase.
