Editor: I noticed while looking over tho column* of joitr valuable pa per that the Mayor and Council had gran tod to' the Maooh A Brunswick Railroad Company permission to chango the route by which they reach 10 BraaUog charters to municipal and lion depends, solely, npnn the legal construction that should lie given in this forty-third section. Tbu individ ual, whoever be may be, who drafted this section, evidently intended to protect the people of Brunswick against the insatiable rapacity of rail road corporations; and the only qi lion to be determined is—docs the language used by him aeooiuplisb this great and good purpose t To settle this question, it is only necessary to apply the rules laid down by the courts for the legal construction t» bo given the langnago used by the Legislature Bay street, by leaving Cochran Ave- uuo at the intersection of George street, and placing their track on and along George street to its intersection with Bay street. I was indeed very much surprised at tins action of Conn- oil, for the matter seems to have been originated and hurried through, no lens votent, at ono and tbs same meet ing. A matter of so much importance as this should have been, it strike* me, referred to the appropriate com mittee, dnly examined and considered by tho committee, and the result of thoir investigation, whether favorable or adverse, reported to Council before taking final action thereon. This U the eonne usually, if not universally, pnrsned by all deliberative or legisla tive bodios; and the propriety and the absolute need of such a eonrso was never, perhaps, more strongly ilia* trated than it is in this particular in- stance. If this course had been pnr sned by Council, the committoo would, in the proper discharge of their duty, have carefully investigated tho matter in all its legal bearings and effects, and they would hsvsbeen compelled, after an examination of tho fundamental law of the city, to have reported ad versely to the granting of any such permission; and they might llinshave saved Council from assuming a posi tion whleh will certainly prove, in the ond, to be untenable, using tho mild est term applicable thereto. Council, in their great haste, mnst havoontiroly lost sight of tho law, which should have controlled them in tho disposition of this matter; aqd now, in order that tho pooplo of Brunswick may dearly understand thoir position in the matter, and to wbat extent their rights hnvo been placed in jeopardy, I proposo to ex, amine, as briefly as possiblo, tho law touohing upon and controlling tho (location, as settled and annouuccd by tho legal tribunals of tho country. I will tberoforo first call attention to tho 43d section of tho consolidated chartor of tho city of Brunswick, passed by tho Legislature on tho 37th day of August, 1373, aud which reads as follows: “ That all tho streets, lanoa, alloys, ways and public squares, as at proscut laid out within tho limits of said city, shall bo and tho same are hereby again declared to be voatod, in feo simple, in tho said Mayor and Council, tor tho use ami benefit, forev er, of the pooplo of tho said city of Brunswick; and no privilege hereto fore granted by the Mayor and Coun cil of said city of Brunswick, or which may bo hereafter granted, to nny rail road corporation, to coustruet and maintain railways in, on or through any of the sroots nr commons of said city, shall ever be constrnod as giving to such corporrtum uu exclusive or perpetual privilege of maintaining such railways in slid cty; un i tho other corporations What are these rales, as settled by the courts? I will first call attention to some of the rat ing* made by tho Supreme Court of oor own State; then to some made by the Bapremo Courts of other States; and then, to one made by the Su preme Court of the United States. Fifth Georgia, page SOI.—"A cor poration ie an artificial b ing—invisi ble, intangible and existing only in contemplation of law. Being the ereatnre of the law, It possesses only those properties Whieb the charter of its creation confers upon it, citherex- prcsaly or as incidental to its very ex istence.” Seventh Georgia, 307.—"In the construction of statntes mode in der ogation of common right, and in favor of corporation* or particular (versons, care should lie tnken not to extend them beyond their express words. 1 Ninth Georgia, 313.—" Orants of exrlnsire privileges, to corporations, are to be strictly construed; and if the terms of tho grant aro ambiguous, tho ambiguity mnst npernto in favor of the public. Eigth Ind., 34.—“Tho action of municipal corporations is.to bo held strictly within the limits prescribed by statute. Within these limits they aro to lie favored by the courts." Twenty-second Iowa, 331.—" If land ia dcdicnlo.1 as a public square, and accepted os such, a law devoting it to other nsrs is void, beenuaa vio lating contracts." Tho Supreme Coart of tho Unitod States baa made, among many others upon this subject, tho following rul ing: “ Municipal corporations, in their action, aru confined to a strict con struction of the grants of power con tained in thoir charters. If, upon tho whole, thoau ho fair, rcaaouablo and substantial, doubt whether tho Legis latino iuteudeil to confer tho authori ty iu question, particularly if it re lates to a matter cxtrn-iiiuuici(iul or unusual in its nature, nml tliu exercise of which will he nttondod with taxes, tolls, assessment, or bnrdeua upon tho inhabitants, or oppress them, abridge natural or common rights, the doubt should lie resolved iu favor of tho citixone, urn) against Ihu munic ipality.” I could rite many oilier rulings, equally as strong mid applicable as these, but it is not, I think, necessary, for thoau cited will prove, 1 siu satis fied, more than sufficient to dearly aud fully siilinlaiitinlu mv pesitson; aud 1 will, therefore, now proceed, ill my feeldo manner, to analyse tho for- ty third section of the i hnrlcr, aud then apply tho rulings then-lo. And first—The legislature solemn ly rc|ieats the declaration made by several previous Legislatures, that all llu streets, luiirs, alleys, ways and thing, os a matter of right, no mntter I bow obtained. Thirdly—The Legislature declares that the Mayor and Council shall con trol, wholly aud absolutely, all mid ev ery railway (til bin the city, amt shall alone determine tbrungu what street* (now mark the words, “streets”) rail, way* shall be carried, to what point* they shall extend, Ac. The lungmige used in this danse is also strong, bnt not any more strong than the occa sion requires. The peoplo, in not be protected agninst railroad corpora lions, soulless and pitiless ns >hey are, if it be possiblo to protect them by the use cf human lnnguagc. Fourthly—Tho Legislature, fearing evidently that the Mayor and Conn eil might, at some time, transcend tho authority and power given them, to the iujnry of the people, declares that the Mayor and Council shall have full authority and power to cause any and all railways to be removed from tho street* or common* (mark, again, tho words, “streetsorconiioous”) whenev er a majority of all the lcgul voters of the city, except those only paying street tax, shall determine, hy ballot, that the aamo have become a nuisance or detrimental to the into-reals of tho city: The langnago here used ia still stronger, if possible, hat mil any stronger than tho necessity of the case demands. Tho people must and ahull he protected in their rights; and if the Mayor and Council should, from any cansc, fail to protect them, the peoplo aro empowered to take the matter in to their own bands, nml thus force Council into a proper discharge of their duty.
