Tho facts of the cose are sim ply these: Aiken had some words with his fa'ieud Joe, and, as is too frequent ly tho caso with mon of his stamp, failing to convince Joe, resorted to tho inevitable pistol, whereupon Joe appealed to the law iu the person of tho "newly appointed Justice” for protection. Not being iu a “nut- cracking” humor, as yonr correspond ent would fain have you believe, and boing “noAv” and somewhat unfamil iar with the duties of his position, tho Justice rode from his office to tho storo owned by tbe Georgia Land and Lumber Company to invostignte whether or not the (nets in the caso warranted an arrest. Upou finding that Joo’s statements were in the main correct, ho deputized Mr. Hays, tbe gentlemen iu charge of the farm ing operations of this Company on St. Simons, ns special bailiff to arrest Ai ken. Aiken rofnscd to be arrested, whoroupon the Justice, very properly, deputized ono or two bystander to as sist in tho arrest, which being effected, tbo posse uud their prisoner having loft tho store, the Justice bethought himself of the fact, that he had no place to secure tho prisoner in tho event of his not giving bond foi his appearance, therefore, as the negro had resisted arrest, aud as the Jus tice’s duty was to uso all proper means to hold him until he could be tried, lie took Mr. Elliot aside nnd an! ed, not "demanded, ’ the loan of a pistol with which to arm his impromptu guard. Mr. E. promptly procured the pistol and handed it to the Justice, at the same time tendering him, uot i dvng*hot, but an ordinary loaded rid ing whip, remarking as he did so, "you may find this useful, also,!’ or some remark of that nature. This, mind you, occurred ufter the prisoner had left the store As regards the rope, it is customary when a person hinj.i an article, although it may chance to be “twenty-live feet of rope,” to >’<•- 7ued it be forthcoming when he gets ready to louve. While I deeply sympathize with the evident “pain that it gives us to chron icle the disnmi failuro, still I fail to sec where the failure, on the part of tho Justice, comes in.
