HE petition of John H. Marks shew- ‘
eth that he was lately the purchaser at she
rtd’s Sale in said county, of a tract oi land sold
as the property of Absalom Hendrick, who
then redded upon the premises, containing
two hundred acres, more or less, lying on the
south fork of Broad rjver, adjoining lands
graxited to Noah Cloud, on the cast and on
the south, bounded on Broad river—and
stating that there was an original deed of
conveyance of said land from one Samuel
Nelson to said Hendrick* and under which
deed the said Hendrick derived title—which
said original deed is lost or mislead so that it
cannot now be found-—and that a copy of
said deed so near as can be recollected, toge
ther with an affidavit of its loss are filed in
the clerk’s office of said court ■>—and praying the
establishment of said copy in lieu of the origi
■rai.
On motion of counsel for the petitioner* it
is ordered! that a cqgv of this petition and or
der be published once a month for the teem of
six months in one of the public gazettes of
this state —and that unless sufficient cause is
then shewn, the said copy will be established
in lieu of the original.
