women to preach. They do so in this lat

Murdf.r in Louisville Ga.—Dr. Benjamin
Ayer, member of the legislature was found
dead in Louisville on last Friday morning
with a bullet hole through his head.
Suspiscion rested upon a negro named Wil
son, who was arrested, and Ayer’s pocket
book and money found in his piossesion.
President Grant has nominated one Ed
win Butcher (colored) for assessor of the
third District of Georgia. If his nomination
is confirmed, wu’il bet that Butcher, butch

Railroad.
At the Meeting of the parties appointed
by the Legislature as Commissioners of the
Baiubridge, Cuthbert and Columbus RaiL
road, held iu this place on Monday last, to
elect a President and Board of Directors for
the present jear, the following gentlemen
were elected:
Hon. B. F, Bruton, Col. Richard Sims—
Baiubridge,
Col. A. Hood, Capt. M I. Atkius—Cuth
bert.
Hon J. K. Barnum—Lumpkin.
The Board of Directors then elected Hon.
B. F. Bruton, President, and the Hon. W.
M. Tumlin of Cuthbert, Secretary and
Treasurer.
The Board then proceeded to frame by
laws, &c.
Hon. B. F. Bruton, though not having a
great deal of experience as a Railroad man,
still possesses extraordinary energy, the
most essential quality in matters of this
kind, and has always been identified with
public enterprises.
The Board of Directors was as good a
seleotion as could have been made, being
all men of influence and wealth.
Hon. W. M. Tumlin, the Secretary and
Tieasurer, is one of the most active and
go a-head sort of fellows that we have ever
met with, any one coukl tell at glance that
business would have to move , around where
he stayed. Col. C. C. Crews was appointed
General Agent. This we think was an
admirable selection. Col. Crews was Colonel
of the 2d Georgia, Cavalry, and his noble
conduct and gallant bearing, upon many
hard fought fields, has inscribed his name
upon the heart of nearly every Georgian.
Col. Crews will do good service in his pres
ent capacity.
The gentlemen from Cuthbert and Lump*
kin left on Monday evening to attend a
large Railroad Meeting, held in the latter
place, on yesterday.
Where Does the Fault Lie?
We have received several communications
from our subscribers at Newton, complain
ing of not receiving their papers regular.
We have made enquiry in regard to the
matter,, and our P. M., informs us that he
has forwarded our Newton packages reg*
ularly. We know the P. M. at Newton to
be a good clever fellow, probably too much
so, but we are of the opinion, if he would
open the mail hirriself, instead of allowing
half a dozen or a dozen boys, or any one
else that chooses to go into the office and
assist him, (which is a positive and
violation of P. O. Department regulations,)
we know our subscribers would receive
their papers regular.
Papers, don,t cost much ’tis true, but
there are plenty of pnrps who are too stin
gy to subscribe for a paper, always hang
ing around the Post office, ready to assist
the Post Master to open the mail, (Provided
he will allow them to do it,) in order to imbez
zel a paper or two.
We know that our paper is mailed reg*-
ular to every subscriber, and if the P. M’s,
will only keep volunteer assistants out of
their office’s, our subscribers will receive
their papers.
Iu the last issue of the Early County
News, we noticed the proceedings of a
railroad meeting held in Colquitt—said pro
ceedings, at the request of the citizens of
Miller, we expected to publish—but some
infernal whelp entered otfr office, and took
therefrom, the paper containing said pro
ceedings; thereb}’ preventing us from pub*
lishing them.
While we do not object to lending, or
giving our exchanges to any one, after
they have been perused by ourselves; we do
most seriously object to Tom, Dick and
Harry, coming into our office and carrying
away our papers, without first getting our
consent* We consider them property nn»
til thrown aside. We are then perfectly
willing to give them away to any body»
provided the “devii” don’t seize and dispose
of them.
We can assure our readers that the citi
zens of Miller artfully alive, as to the im
portance of building the Bainbridge, Cuth
bert and Colnmbas Railroad, and will do
everything in their power to accomplish
that end.
Miller County—The Superior Court —
Crops, &c-—We attended on Monday last
the Superior Court, Judge Harrell, presi u
ding, discharged his duties with ability
and dispatch. The following legal genlemen
from afar, were in'atteudance; our “festive’
friends, Hon. Isaac E. Bower, Col. Richard
Sims, and J. C. Rutherford, Judge B. B.
Bower and ourself , made up the Baiubridge
delegation. Peter J. Stroz ! er, of Albauy,
and Holmes Powell and Judge Swan of
Early were present. Hon. S. Wise Parker,
Solicitor-General, was on hand busily en
gaged in looking after the crininal docket.
Notwithstanding the severe cold weather
during the week, accompanied by a slight
frost the corn and cotton looked well. The
area planted this year in cotton, does not
we think, exceed the amount planted the
past year. Her people have used large
quantities of fertilizers and have prepared
their lauds much better than they did last
■year. The freeduien are working well.

of seeing the smiling countenance of our
friend Grouby, Editor of the Early County
News. He was in fine health and spirits.

seems to be daily increasing. Senator’s

thing in their ptwer to bring it on, and it
really seems that is inevitable, unless
the English Government backs down from

by the State. If our 1 citizens will only take
hold of the matter, with that spirit and en
ergy which they ought, there is no doubL
but what the work will be commenced from
this point by the first of July. Let Our
Motto be “Sharp and Quick.”
AN ACT
To INCORPORATE THE BaINBRIDOK, CuTHBERT
and Columbus Railroad Company, and for
OTHER PURPOSES THEREIN MENTIONED.
Section 1, Be it enacted by the Senate
and House of Representatives of the State of
Georgia in General Assembly met, and it is
hereby enacted by the authority of the
same. That A. Hood, W. M. Tuinlin, W.
H.. Young, J. V. Heard, L. O. Jackson, T.
A. Swearingen, W. J. Hudson, F. L. Pep
per, B. F. Bruton, W. A. McDougald, M. A
Hardin and J. B. Cleghorn or a majority of
them, are hereby constituted, a Board of
Oommifesioners for the purpose of organi
zing the Baiubridge, Cuthbert and Colum
bus Railroad Company.
Sec. *2, And it is hereby further enacted
by the autority aforesaid, That the capital
stock of said company’shall be .divided into
shares of one hundred dollars each, and
shall not. exceed twenty-five millions of
dollars. •
Sec. 3, And it is hereby further enacted
by the authority aforesaid, That the said
Board of Commissioners is hereby required
when the sura of fifty thousand dollars
shall have been subscribed to the capital
stock of said company, to convene the sub
scribers to the same or a majority of them
for the purpose of electing from'their own (
number a board of five directors, to man
age and oontrol the affairs of said company
for one yesjr, or until their successors are
elected and installed, and said board of di
rectors as well as all other boards which
nifty thereafter be selected, shall select
from its own number, a President, and
have power to adopt by-laws, for its own
control and to appoint and employ such offi
cers, ageuts/and servants as it may deem
proper.
Sec. 4, And it is hereby further enacted
by the authority aforesaid, That in the
election herein before provided for, each sub
scriber to the capital stock of said com
pany shall be entitled to one vote for each
share subscribed by him or her, or which
he may represent by power of ‘attorney,
and in all elections thereafter each person
shall only be entitled to one .vote for each
share of the capital stock of said company,
which he or she may own or represent by
power of attorney upon which twenty per
cent, has been paid, provided, no one shall
be excluded from voting if the twenty per
cent, has not been called for.
Sec. 5, And it is hereby further enacted,
by the authority aforesaid, That when said
board of cummissiohers shall have com-*
plied with the requirements set forth, and
an election of a board of directors shall
have been held as provided for in section
third of this act, the books of subscription
to the capital stock of said company togeth
er with all other books and papers apper
taining to the business of said company,
shall be turned over to the board of direc
tors and the functions of said board of
commissioners shall cease and determine.
Sec. 6, And it is hereby further enacted
by the authority aforesaid, That when the
subscribers to the capitalstock of said com
pany shall have convened and elected a
board of directors under the prov Lions of see*
tion 3rd of this act, they their associates amt
snccessros shall be deemed, held and consid
ered as & body corporate and politic, under
the name and style of the Baiubridge, Cnth-*
bert aud Cplumbuf Railroad Company, with
perpetual'succession, and all the rights,
powers arid* liabilities common, and neces*
sary to such a corporation, and the organic
zation of said company shall bo complete.
Sec. 7, And it-is he re by-further enacted
byjhe authority aforesaid, That said com
pany shall have power to contract, main
tain, equip and use a Railroad from Bain
bridge through Cnthbert to Columbns, and
from Bainbridge, to such point on the Flor
ida line as it may determine, to accept,
purchase, have, Tease and convey, any prop
erty, real, personal or mixed, and to erect
such buildiugs. and shops, operate such
machinery, and do such other things as it
may deem proper for its advantage and
benefit.
Sec. 8, ‘ And it is hereby further enact*
ed by the authority aforesaid, That in ail
cases when a question of right of way
arises and the company cannot agree with
the owner,or representative of the land up
on which" it is proposed to e’uter, the work
of the company may proceed as if there was
no disagreement, but the Sheriff of the conn*
ty in which said land is located, at the re
quest of either party shall summon a jury
of five disinterested freeholders of said
county, who shall assess the damage to be
paid by said company, after being sworn to
take into consideration the enhanced value
of said land, from 'he building of raid road,
and to do justice between . the parties, and
the finding of said lory shall be final and
conclusive against both parties, provided,
each has received frou^tlie said Sheriff ten

ing of said jnry, and neither party appeals
to the Superior Court in ten days theveaf

Sec. 9, Audit is hereby further enacted
by the authority aforesaid, That the right of
way of said com pa*iy shall not exceed three
huudred feet in width.
Sec. 10, And it is hereby further enacted

company shall have power to receive land
or other property, in payment or in part
payment of the subscriptions to its capita!
stock, at such valuation as may be agreed
on or'may be assessed by three freeholders
under such rules and regulation-, as may
be adopted by it, and to mortgage, lease.
