been last sold, assigned, transferred
and conveyed to BA Mortgage, LLC,
by Assignment datedAugust9,2001,
securing a Note in the original prin
cipal amount of $47,250.00, the
holder thereof pursuant to said Deed
and Note thereby secured has de
clared the entire amount of said in
debtedness due and payable and, pur
suant to the power of sale contained
in said Deed, will on the first Tues

feet to the Point of Beginning, all ac

Book "C", page 66, in the Office of
the Clerk of Superior Court of Lee
County, Georgia.
Also conveyed is a right for the
owner, their family and guests, to fish
on the lake adjacent to the above de
scribed property as shown on the plat
of the subdivision as recorded in Plat
Book "C", page 66, in the Office of
the Clerk of the Superior Court of
Lee County, Georgia.
This conveyance is made subject
to a public road (Miller Road) ease
ment 20 feet in width across the
northern end of the conveyed prop
erty as more fully shown on the plat
of the subdivision recorded in Plat
Book "C", page 66, in the Office of
the Clerk of the Superior Court of
Lee County, Georgia; to other ease
ments, visible or of record, affecting
the described property; and to the
valid and enforceable zoning ordi
nance of Lee County, Georgia.
Less and Except: Any portion of
said property as lies within the right-
of-way of County Road #74.

together with all fixtures and per
sonal property attached to and con
stituting a part of said property, if
any.
Said property will be sold subject
to any outstanding ad valorem taxes
(including taxes which are a lien,
whether or not now due and pay
able), the right of redemption of any
taxing authority, any matters which
might be disclosed by an accurate
survey and inspection of the prop
erty, any assessments, liens, encum

record superior to the Security Deed

and the holder having declared the bal
ance of the indebtedness due, this sale
will be made for the purpose of pay
ing the indebtedness secured by the
Security Deed.
The proceeds of the sale will be ap
plied to the payment of the indebted
ness and interest and all charges and
expenses in connection with this fore
closure as provided in the security
