Carter announces Student Health and Fitness Act
Sen. Joseph Carter (R-Tifton) speaks to an audience of health care professionals, educators,
administrators and students at the State Capitol. He is introducing legislation that will require a 150-
minute per week minimum of PE instruction for K-5 students, and plans for 225 minutes per week for
grades six through eight, as recommended by the American Heart Association.

Eminent domain, voter ID,
other issues to dominate 2006
Session
The Georgia Legislature was
in recess last week as we tack
led budget priorities, but this
week we are back in the swing
of things and will be tackling
those issues that are important
to you. One of the most talked
about issues in the past year
has been eminent domain - a
subject few Georgians knew
much about until it captivated
the press last year following
the U.S. Supreme Court’s rul
ing to allow cities and coun
ties to use eminent domain
for “economic development”
purposes - in other words,
taking away the property of
private citizens to build hotels,
businesses, etc., to create a

higher tax base.
Many downtown areas
across the nation are being
affected by this decision
- people who own homes or
“mom and pop” businesses in
thriving areas are being forced
out to build larger businesses,
hotels, office space, etc. In
more rural areas, property
is being “condemned” under
the guise of eminent domain
to build luxurious resorts or
industry. That’s not the intent
of eminent domain. Eminent
domain is only to be used for
a legitimate public purpose,
i.e. roads, parks, schools, etc.
- not to put money into the
developers’ pockets.
The Senate debated the
Voter ID legislation on Tues
day - this time to “perfect”
the legislation passed during
the 2005 Session. Senate Bill
84 specifies that the State will
provide free identification
cards to all registered vot
ers upon request, and that all
county boards of election and
all local offices of the Depart
ment of Driver’s Services
- more than 150 locations
across the state will provide
the state-issued ID card. The
House of Representatives
approved the final version on
Wednesday and Governor
Perdue signed the bill into law
on Thursday.
In other news, last week was
a great week for Georgia’s
public schools. Senate Bill
390, a bill that would re
quire that every local school
system spend a minimum of
65 percent of its total operat
ing funds on direct classroom
expenditures, beginning
with Fiscal Year 2008, was

Rakeem Lewis had a big surprise Monday. Around
2:00 the intercom came on in his second grade
classroom. “Mrs. Greely, please send Rakeem to
the office to go home,” Mrs. Janis announced.
He slowly gathered his things and headed for
the office. Waiting for him when he entered the
office was his father, Andy Lewis, who has been
serving in Iraq. Rakeem and his father shared a
heartwarming reunion.

passed out of Committee, and
will soon come up for a vote
on the Senate floor. Senate
Resolution 655, known as the
HOPE Chest Amendment, also
was approved by the Senate
Higher Education Committee
this week. These two pieces
of the Governor’s education
agenda for 2006 are crucial
to the continued improvement
of Georgia’s K-12 education
system, and I will work hard to
ensure their passage this year.
Lastly, during a press confer
ence this week, I announced
another education bill, known
as the Student Health and
Fitness Act of 2006. The
legislation will require formal
physical education in Georgia’s
elementary schools. This leg
islation will ensure that all of
Georgia’s children are partici
pating in a thorough, adequate
physical education program
at their schools. We need to
be absolutely sure that our
children are properly informed
on how to maintain a nutritious
diet, and that they are properly
educated in the areas of health
and physical fitness as well.
The Student Health and Fit
ness Act prescribes a 150-min-
ute per week minimum of PE
instruction for K-5 students, as
recommended by the Ameri
can Heart Association. The
Act asks local school boards
to develop plans for delivering
PE instruction to students in
grades 6-8. Ultimately, the leg
islation authorizes each local
board of education to develop
the coordinated school health/
physical education programs
beginning with the 2006-2007
school year.
It is a great time for our
schools and our children.
