County Commissioners To
Meet Thursday, February 9
The Lee County Commissioners will meet
Thursday, February 9 at 6:00 p.m. at the
County Administration Building.
Plaques will be presented to the firefighters
that went to Mississippi in the Katrina effort.
Plaques will be presented to the Public Safety
Explorers that attended Winterfest in Gatlin-
burg, Tennessee.
Public hearings will be conducted by the
commissioners.
Alvin Adams and Allan Gleaton are request
ing rezoning of 293.94 acres from AG, Active
Agriculture District to R-l Single Family
Residential District. The planning staff and
planning commission recommended approval.
Betty Day is requesting a Conditional Use
Permit to permit the secondary residence to
be used as a group home. The planning staff
recommended approval conditioned on main
taining state license, limited to elderly care and
only for Ms. Day. Planning commission recom
mended denial.
Rebecca Belcher requested a variance
minimum lot size and setback for AG-1 zoned
district. The planning staff and planning com
mission recommended approval.
Flint Ventures L.L.C. are requesting a rezon
ing of 22.336 acres from C-2 General Business
District to R-2 Multi-Family Residential. The
planning staff and planning commission rec
ommended denial.
Lee County Board of Commissioners request
ed a rezoning of property to R-l Single Family
Residential Districts, C-l Neighborhood Busi
ness District, C-2, General Business District.
The planning staff recommended approval
and the planning commission recommended
approval of R-l zoning only with road access
every 500 feet and no residential driveways
allowed to directly access Cedric Street exten
sion.
The commissioners will hear a wireless com
munication facility appeal. Verizon Wireless
submitted an application for a cell tower to the
commissioners.
The commissioners will consider a contract
with Vista Care for hospice transport.
The commissioners will be asked for authori
zation to bid out EMS billing services.
The commissioners will consider three bud
get amendments. The budget amendments are
a building inspector position, EMS over-time
budget and an amendment
for the parks and Recreation
Department.
On the agenda is the renewal
of the Intergovernmental
Agreement between the county
and recreation authority.
Final acceptance of Armena
Road paving project is on the
agenda. Also on the agenda is
authorization request to pre
pare right of way acquisition
for Eagle Pond Road paving
project.
The commissioners will be
asked to accept donated land
for the Smithville Fire/EMS
station. The commissioners
will be asked to approve the
USDA Service Center lease.
Evidence Suppressed
In Ealum’s Case
In a hearing held last week, Superior
Court Judge Rucker Smith ruled to suppress
evidence obtained in the case against Jo
Ealum that resulted when several individuals
were charged with underage consumption
of alcohol at Miss Ealum’s residence on
Highway 19 South in December 2004.
The charge against Miss Ealum was made on the
recommendation of the Lee County Grand Jury that
was hearing evidence involving some of the individu
als charged with underage consumption at the Ealum’s
residence.
Cecicila Cooper, District Attorney, said that she will
appeal the judge’s decision and will continue with the
prosecution of the case.

Ms Sara Ann Honored
Sara Ann Arthur was recently awarded the Treasure Award from the Albany
YMCA. The award is given to volunteers who go above and beyond and
demonstrate the YMCA values of caring, honesty, respect and responsibility.
Mrs. Arthur was an integral part of the develoment of the local YMCA. She
taught swim lessons, ran youth camps and her programming was the basis
of many of their current programs. She has always had the community’s
children close to her heart. She is currently very ill and so her husband
Sam Arthur accepted the award on her behalf. Pictured are Sam Arthur

Kendra Leann Savior, 19,
of 801 South Pecan Street,
Cordele, was charged with
shoplifting at a business in the
2800 block of Ledo Road Feb
ruary 6. The case was worked
by Cpl. David Cheshire.
Larry Allen Pettis, 22,
of 316 Richardson Road,
Smithville, was charged with
disorderly while intoxicated
February 5 by Sgt. Larry
McDuffie Jr. Sgt. McDuffie
was dispatched to the above
incident location in reference
to a fight in progress. A friend
of Pettis attempted to keep
Pettis from driving while he
was drinking and a disagree
ment occurred. Pettis was
charged following the incident.
Saundra Faye Litman, 46,
of 1578 Hwy 19 South Apt.
2102, was charged with simple
battery February 5 by Dep.
Rob Stull. Dep. Stull was

pute. Litman was charged fol
lowing a dispute with another
person. The person stated that
Litman struck her following a
verbal argument.
Wesley Bryan Lunsford, of
194 First Road, Leesburg, was
charged with reckless conduct
and cruelty to animals Febru
ary 5 by Cpl. Adam Darrah.
Cpl. Darrah responded to
194 First Road in reference
to shots fired. Upon his ar
rival, he made contact with
Lunsford, who had a strong
odor of alcohol coming from
his person and was drink
ing a beer. Lunsford told the
officer that he was tired of his
Golden Retriever leaving the
fenced-in area and he killed
the dog. He was arrested for
reckless conduct and cruelty
to animals.
Konterrias Dante Thomas,
31, of 100 Winding Way
Apt. D, was charged Febru
ary 4 with driving while
license suspended by Dep.
John Shuff. The officer was
dispatched to the 100 block of
Augusta Court in reference to
an automobile accident. Upon
running a check of Thomas’
license, he was advised by
dispatch that Thomas’ license
was suspended. He was
placed under arrest for driv
ing while license suspended
and was also issued a citation
for failure to maintain lane.
Jay Richard Shultz, 24, of
151 Groveland Drive, Albany,
was charged with D.U.I.,
failure to maintain lane and
attempting to elude police
officer February 4 by Dep.
Keith Barfield. Dep. Barfield
observed Shultz cross the
white outside line three times
on Hwy 19 South near the
Century Fire Station and
made a traffic stop. Shultz
was tested on the alco-sensor
with positive results and he
was arrested.
Ralph Robert Wells, 29,
of 112 B Winding Way,
Leesburg, was charged with
disorderly conduct February
4 by Dep. Rob Stull. Dep.
Stull responded to a residence
in the 1500 block of Hwy 19
South in reference to a dispute
where Wells was issued the
citation.
Judith Harvey, 21, of 1208 B
Crawford Drive, Albany, was
charged with shoplifting at a
business in the 2800 block of
Ledo Road. Lt. Jim Lovelace
worked the incident.
Sharen Seay, 21, of 3603
Oliver Drive, Albany, was
charged with possession of
cocaine with intent to distrib
ute, use of a communication
device while committing a
crime, driving while license
suspended and open con
tainer February 3 by Dep. T.
Hormell.
Jack Hutchinson II, 32, of
254 Stanton Drive, Smithville,
was charged with possession
of cocaine and possession of
Schedule III drugs February
1, 2006. The arrest was made
by Dep. F. Hormell at 254 N.
Stanton Drive, Smithville.
Adrian Demond Gardner,
25, was charged January 31
with driving while license
suspended and no proof of
insurance by Dep. Rob Stull.

Ronnie Dudley, of Stevenson and Palmer, met with representatives of the Lee County Utility Authority,
Lee County Commission and the Leesburg City Council to discuss the future needs of Leesburg. Mr.
Dudley said that because of the growth of the city with the Lee Farms development and the construction
of new schools, the city would need to upgrade its sewer facilities. If the city uses water and sewer
customers to pay for the increase the average water and sewer bill will be over $90 a month. Mr. Dudley
said that the city would need to work with the Utility Authority and the county to find other ways of
funding the expansion.

running. Dep. Stull told Gard
ner that someone had called in
a complaint about a car block
ing traffic. The officer asked
Gardner where he was headed
and he said to get lunch. Dep.
Stull called in his tag informa
tion to dispatch and the vehicle
came back as not insured.
When asked if he knew he did
not have insurance, Gardner
replied no. When asked for his
drivers license, he said it was
inside his place of employ
ment. When his information
was ran through GCIC, his
license came back as sus
pended. Dep. Stull then placed
Gardner under arrest for driv
ing while license suspended
and no proof of insurance.
