Grand Jury Presentments.
O
Banks Superior Court, March Term, 1914.
We the grand jurors chosen and
qualified at the present term of
court, respectfully submit the fol
lowing recommendations and pre
sentments, to-wit:
Through the various committees
appointed from our body, the pub
lie property and records have been
examined and the following reports
made:
Vacancies Board 01 Education.
We found from the report of the
County School Superiuteudent that
three vacancies existed on the coun
ty board ot education and the va
cancies were filled as follows: W.
Baxter Smith elected to fill vacancy
caused by the expiration of the term
of office of W. G. Parks, Mr. Parks
not desiring to serve longer; Gresh
am Ducket elected to fill vacancy
caused by the expiration of the term
of office otS. Duckett, Mr. Duckett
not desiring to serve longer: that
W. F. Morris, Sr., be elected to
succeed M. L. ('handler whose
term of office expired and who is
also a citizen of the same district
as Mr. W. B. Smith.
We note with a great deal of in
terest that ten of the twelve road
districts of the county have pur
chased small road machines for
grading and smoothing the roads.
We commend the ordinary for
settling the debt of the Atlanta
National Rank by securing time
and re newing the claim by issuing
warrants as shown in his state
meut.
Further we commend the ordi
nary for settling the suit now
pending in favor of the Northeast
ern Ranking Cos., by re newing the
obligation, payable in four pay
ments J Jan. 1,1915, Jan. 1,19 Hi,
i Jan. 1, 1917, and Jan. 1, 1918.
There further appearing a vacan
cy on the board of education by
the removal of A. W. Henderson
into the town of Maysville, said
town having a local system with a
local board of education of its own.
Bee vol. I Sec. 1479 of the Code of
1911 which says that members of
the Board of Education of the
county shall be selected from that
portion of the county not embraced
within the territory covered by
such local system. To fill the va
eaucy caused by the removal of Mr.
Henderson as above stated we elect
to till said vacancy Mr. Gibson
Waters of Grove River district.
We recommend thatC. A. Meeks
be paid Forty Five Hollars out of
court expense fund for publishing
report of special grand jury com
mittee made to Se[ tember Term
1913 of this court. The sum of
Fifteen Dollars having previously
been paid for publishing the pre
sentments at that term of said
court.
We recommend that M iss Ethel
Chambers be paid Ten Dollars for
making index to two record l>ooks
in ordinary’s oflice.
We recommend that the follow
ing persons be allowed on pauper
list and each be paid Five Dollars
per quarter out of poor fund, be
ginning with fiist quarter 1914, to
wit: T. A. Lewallen, Margaret E.
Guest, Harriette Roper. Dulcina
Mullen, Mary Jackson, and Clara
Gowder, colored.
We recommend that One Hun
dred Dollars be- appropriated for
treatment of hookworm.
ORDINARY.
We have examined the records
and vouchers in the ordinary’s of
fice and found them neatly and
correctly kept so for as we were
able to discern. See Report. Ex
hibit “A.”
SHERIFF.
We found the sheriff’s books
neatly aDd correctly kept so far as
Ye could find out in so short a time.
BANKS COUNTY JOURNAL
CLERK.
We have examined the lx>oks of
the Clerk of the Superior Court
and found them neatly and cor
! rectly kept as far as we could as
certain . Everything is arranged
in a convenient manner, and we
commend the clerk for the manner
in which the office is kept.
TAX COLLECTOR.
We tiud that the books and rec
ords of the Tax Collector are neatly
and correctly kept so far as we
could ascertain, and that he con
ducts the business in a safe and
business like manner. See Report.
Exhibit “B.”
TREASURER.
We have examined the books
and vouchers of the County Treas
urer, and find the books neatly
and correctly kept so far as we
could ascertain, proper vouchers
for all moneys paid out and find
cash on hand #3374.10. See Re
port. Exhibit “C.”
N. P. & J. P. DOCKETS.
We find the N* P. & J. P. Dockets
in most instances neatly and cor
rectly kept as far as we could set 1
eveept that some have failed to
enter the cost in some eases on
these dockets as required by law.
COUNTY SCHOOL SUPERIN
TEN DENT.
We examined the books and
vouchers of the County School
Superintendent and found them
well and correctly kept, as far as
we were able to discern: 11 is
vouchers are all in proper order
and correspond with the itemized
statements made to the State Board
of education and approved by them.

There was no report on the gen
era! condition of the schools of the |
county, the number white and
black, progress etc.
PUBLIC BUILDINGS.
We find the court house in very
bad condition and very much neg
lected. We find many of the
blinds destroyed and gone, others
badly shattered. Many window
lights broken out. The guttering
on west side Is too.
PAUPER HOME.
We find the Paupers properly |
cared for in some respects, but not;
properly or decently situated. Wc
find two males and two females all
white, housed in one room. There!
are four l>eds in this room. The
Sheriff of the county has care of
the inmates so far as board, fuel
etc., are concerned. The inmates
are well satisfied with the diet fur
Dished, but complain for being
housed and cramped and crowded
into one small room.
CONVICT CAMP.
We fiud at the camp 15 mules in
fair condition, three hogs weight
about 400 in which the county
owns ODe half interest; 4 two
horse wagons in good running con
dition; 1 one-horse wagon, 1 dinner
wagon, 1 buggy, 6 wheelers in good
order, 3 in veiy bad condition; 10
convicts, 8 being white, 11 black;
2 blood hounds, the tents are worn
out; two portable cages in fair con
dition.
ALTERNATIVE ROAD LAW.
We the Grand Jury find that the
Alternative Road Law as defined
in Sections 694 to 704 inclusive of
the Civil Code of Gorgia 1910-191 J
is now of force in this county, and
we therefore recommend that said
alternative system be continued in
said county of Banks.

Exhibit “A”
Gkokgia— Hunks < bounty.

county.
i, T. F. Hill Ordinary, of said
county, beg leave to submit the
following report to wit:

account of accumulated indebted
ness by former Ordinary Judge Lo

administration of the Or

Making a total of *26,136.49
Pursuant to a recommendation
of the Grand Jury at the last term
of this Court, I compromised and
settled the claim of the Atlanta
National Bank against the County;
the claim, principal and interest
approximating the sum fo $16,000,-
00 as follows: A credit of $5,000,00
was allowed by the purchase of the
County iarm, by the Bank. By a
credit of $1200.00 agreed on as il
legal and uncollectable and further
reductions reducing the balance to
the sum of $9,076,26 for which
warrants issued as follows: One
for $2,854.17 which has been paid.
One for $3,035.42, due Dec. Ist,
1914, and one for $3,196.67 due
Dec. 1915, with interest at 6 per
cent per annum.
1 have succeeded in settling the
old claims against the County prior
to January Ist, 1913 in such away
as to reduce the inded ted ness of
the County from $28,882.41, at the
last term of the court to $14,208.14,
to wit: $6,222.09 due the Atlanta
National Bank, and $7,986.05 now
in suit in favor of the Northeastern
Banking Company,
If the work of the Tax assessors
i avails much, by an increase in the
.taxable property of the county, I
hope to relei va the county of its
present indebtedness in an other
twelve months,
lam buijding Joel's and abut
ments, preparatory to the erection
of first class bridges at the most
important places in the county as
rapidly as 1 can with the convicts
and distributing the work over ti e
county as well as possible, grading
s and repairing the worst places on
the roads.
I called an election in the several
Militia Districts of the County in
February for the purpose of select
ing supervisors of roads for each
j district, and appointed the several
supervisors elected, overseers, and
placed them uuder good aud
solvent bonds for the performance
if their duties as such.
These Overseers in return, with
I only two exceptions, have pur
chased up to date road machines
: and are doing the best road work
in the history of the County,
thereby carrying into effect more
satisfactorily the alternative road
law, and I believe in another twelve
months we will have as good roads
as are to be found in this part of
the State.
The four paupers of the comity
are comfortable and well cared for
by t he Sheriff’ of the county.

Fight In Gillesvill; One Dead
Sidney Pace, a negro of near
Gillsville, shot and killed George
Lyle, another negro, Sunday night
as a result of the latter having shot
into Pace’s house, and otherwise
disturbed the negro aud his family.
It seems that Lyle and a man
named Jarrett in passing Pace’s
house had pulled their re volver
and fired into the residence several
times, barely missing Pace and
members of his family.
Pace went out aud tried to get
the men to leave, it is said when
Lyle pulled his gun and snapped
at Pace. The latter then drew his
his gun and shot Lyle twice, kill
ing him instantly.
Coroner Sto.v was notified of
the tragedy Monday morning
and went over and held an inquest
the jury rendering a verdict of
justifiable homicide.
Jarrett, who was with Lyle at
the time of tbe killing, was put
uuder a #2OO boud for shooting on
the public highway.—Gainesville
