1. *Every postmaster is required to
give notice, (returning doe3 not meet
the requirements of the law) when a
subscriber does not take his paper out
of the office, and state the reason for
its not being taken; and a neglect to
.do so makes the postmaster responsi
ble to the publisher for the pnyment
thereof.
2. Any person who takes a paper
from the postoffice, whether directed
to his name or another, or whether
he has subscribed or not, is responsi-
« ble for the payment thereof. j
3. If a person orders his paper dis
continued he must pay up all arrear
ages, or the publisher may continue to
send it until payment is made, and
collect the whole amount, whether it
be taken from the office or not. There
can be no legal discontinuance until
payment is made.
4. If a subscriber orders his paper
to be stopped at a certain time and
the publisher continues to send it,
the subscriber is bound to pay f<y it
if he takes it from the postoffice. The
law proceeds on the grounds that
man must pay for what ho uses.
5. The courts havo decided that
refusing to take newspapers from the
po3tofficeor removing and leaving
them uncalled for is prima facia evi-
donee of intentional fraud.
