NO ACTION TAKEN IN
PEACH COUNTY CASE
Atlanta, Dec. 6.—That there will
i no executive proclamation issued
i the matter of the vote on Peach
county became certain yesterday.
The communication from Secretary
of State McLendon to the Governor
Monday afternoon after the original
certification leaves the matter open
to either of two conclusions in
forms the Governor that, on th
of the returns a majority of some
6,000 voted against the new county.
Under the provisions of the law if
the proposal failed of ratification
thsre is no necessity for issue of a
proclamation, and the proposal stands
lost.
It was learned yesterday, however
there is nothing to prevent the
proponents of the now county tak
ing the case into court, if thoy so
desire, for judicial determination,
and it is understood one of the
courses open to that procedure would
be application for mandamus direct
ed against the Secretary of State to
compel his action on the protest field
with him. In respect to that court
action would determine the question
whether or not he is authorized to
hear such a protest.
It appears, though, that such nctio n
will not be taken, at least there is
nothing at this time, to indicato such
intention, and in the absence of
the Peach county matter in the
last general election stands closed.
On the other hand, it is learned
that, if the advocates at a later date
undertake to go into court with the
cas, the opponents of the new coun
ty will file answer to their petition in
which answer it will be set up that
an examination of all the returns will
show more than sixty counties not
cited in the protest among the alleged
irregularities are also found to be
similarly irregular, and these
ties would even more greatly decrease
the vote in favor of the new county.
