A William D. Howell, respectfu-Hy sheweth
that on tbe sixth day of November, in the year
eighteen hundred and sixty-one, James A.
Tweedle of said County, made and executed to
yonr Petitioners his certain deed of moitgage
of that date, conveying to your Petitioners Lot
Number One. (1.) Block Number Twenty-six
(26,) in the Town of Valdosta, County afore
said, for securing the payment of a certain !
promissory note, dated on said sixth day of j
November,eighteen hundred and sixty one and j
due one day thereafter, whereby said Tweedle
promised to pay your Petitioners or bearer
Seven Hundred Dollars, which note and mort
gage are here to the Court shown. Yet your
petitioners aver that said Tweedle, although
so indebted, and to pay said sum of money often
requested, has not paid the same, nor any part !
thereof, but the same to pay wholly refuses.
Wherefore vour petitioners pray the order of
this Court requiring the said Tweedle to pay
into this Court, by the first day of tbe next
term thereof, the principal, interest and cost
due on said note, and that on default thereof,
the said mortgage be foreclosed, and the equity
of redemption therein barred in terms ot the

Howell, that by deed of Mortgage, dated tbe
sixth day of November, eighteen hundred and
sixty-one, James A- Tweedle, conveyed to said
Plaintiffs, lot of Land Number One, Block
Number Twenty-six. in the Town of Valdosta,
County of Loundes and State of Georgia, afore
said, for the purpose of securing the payment
of a promissory note made by said Tweedle to
said Plaintiffs, and due on the seventh day of
November, eighteen hundred and sixty-one, for
the sum of Seven Hundred Dollars, which said
note is now due and unpaid:—lt is Ordered,
that said Tweedle do pay into this Court, by
the first day of the next term thereof, the prin
cipal, interest and costs, due on said note, or
show cause, if any he has, to the contrary, or
that in default thereof foreclosure of said mort
gage he granted to said Plaintiffs, and the equity
of l edemption of said Tweedle therein be for
ever barred, and that service of this rule be
perfected on said Tweedle according to law.
