of the deponents therein men
tioned.

By this public instrument of
declaration and protest, be it
known unto all persons whom it
doth, (hall, or may concern,
that on this present day, being
die 6th of April, in the year of
our Lord one thousand eight
hundred and five, before me
Paul Oilcngren, register in the
royal council, in the Island of
St. Bartholomew aforefaid, by
royal authority, excrciling the
fundi.ions of notary public, in
and for the fame island, person
ally appeared VVm. Brewfler,
late master of the armed (hip
called Nancy, of Charleston,
South- Carolina, in the United
States of America, John Ken
nan, 2d n are, and John Cops,
Loatfwain’s mate cf the said
flip, who being by me severally
duly sworn, upon the Holy E-
Vangelifts of AlmigHy God, de
pose and Gy, and each of them
for himfelf depofeth and faith,
that they* and each of them fad

pacititsaforefaid, from Port-au-
Pii icefl in the island of St.
Domingo, on the 28th day of
February lall pail, with a cargo
of coffee, cotton and logwood,
bound to Charleston aforefaid,
the said ship Nancy being on
the day of her failing from Port
au-Prince, in the island of Sc.
Domingo aforefaid, in good or
der and condition, and well and
fufheiendy found, fitted, victu
alled and manned for the laid
voyage j that they proceeded
thereon without any material
circumstance happening untilthe
third d.iv of the month of
March laftpaft, when cape Maut,
bearing e. distant about four
leagues, the laid ship. Nancy
was brought to by a (hip under
French colours, which proved
to be his Britannic Mcjefty's
ship La Dejirci'y llhit by , com
mander A and from which a boat
was sent on board the Nancy,
with an officer, who, having
mustered the crew, lmpreficd
the boat Twain, gunner and
carpenter, together with nine
men of the laid crew cf the
Nancy, and after fome abusive
and very threatening language,
wanted to force the laid mailer
of the Nancy to give him seven
teen hundred dollars for die wa
ges of the said men so impreff
cd, which being refilled, he
went on beard the frigate La
Desiree, and as loon as laid of
ficer got on board the laid fri
gate, began a smart fire of muf
quetry and large fwivds on the
Nancy, although within hail,

however, their fire, when the
deponents lowered down their
boat, and then the frigate sent
one of his onboard, and forced
the said mailer of the Nancy to
cake on board the frigate the
sum of one thousand and twenty
five dollars, which sum not be
ing fufficient to pay off the men
imprelfed, they brought the laid
mailer on board of his (hip a
gain, and made him take on
board of the frigate a further
sum of live hundred and twenty
four dollars and three quarters,
together with all his papers,
receipt", accounts, clearances,
&c. &c. Which papers being
flridtly overhauled, and the
money tendered by captain
Brewlter, he was fcnt cn board
the Nancy about midnight—
that during the time fa id captain
drew (ter was on board of the
frigate, the boat of the Nancy
being astern, broke loose and
was loft. On the sth day of
the laid month of March, they
had the fat'd frigate Dcfiree in

fighr, and about 9 o’clock r. m.
c;f the fame day lhe bore down
upon the deponents, fired two
cannon (hot, close to them, and
fliortly aiter commenced a fire
of mufquetry on them; they
then boarded the Nancy in their
boat, and after lbme excelTes
left the deponents to proceed,
about 10 p. m. That on the
fame fifth day of March, about
5 o’clock p. :r. they the (kid
deponents saw the island of Ho
ne tga on their weather bow, and
bore away, running under the
weft end of that island, with all
fail let.
On the 6th following, at 3
o’clock p. m. by sea account,
tire laid deponents law a fail
bearing down upon them, which
after coming near enough, was
observed to a be privateer schoo
ner j that the said privateer hav
ing hodded Englifli colours and
fired a gun, the laid deponents
were convinced fne was a French
privateer, and not being able
to run from her, nor to defend
themf lves, having but twenty
men left on board, owing to the
impreifaient aforefaid, hauled
up their courses and took in all

vateer proved to be the schoon
er Perfeverence, from Gauda
loupe, with 4 four pounders
and one tighteen in a circle,
Joseph Rodineaux, mailer, with
ninety-fix men, who immedi
ately took polfelfiion of the
Nancy, and proceeded in for
Sc. Martin’s, where they arriv
ed at Maragal on Sunday, the
24th cf the laid month of
March, the laid privateer keep
ing them company into port;
that after their arrival at the
laid island of St. Martin’s, the
ship Nancy was immediately
dripped, and in four days the
whole of l;er cargo dilcharged,
the laid captain, \\ ilharn Brow
der, and the lecond mate, John
Kennan, being kept priibners
on board the said Hi 1 p Nancy un
til the 27 tii of die said month,
when they, together with the

feat up to this island of Sr. Bar
tholomew, where they arrived
on Saturday the thirtieth of this
fame month, about ten o’clock
in the forenoon. No condem
nation or other papers, except
a pass for the island having 1 been
obtained at the said island of Sr.
Martin’s: wherefore, I, the said
notary at the requell of the laid
deponents, the laid William

When the said officer came
on boaro, he demanded my pa
pers—then ordered my crew to
be muffered. T hey produced
their prore&ions—the laid offi
cer tore teem ...2 pieces, and laid
they could get another for half
a dodar in America, and get
into the boat. After the firft
inffult of firing into the ship had
cealed, they lent their boat on
board with the fame officer,
took me with ttie money on
board to pay my laiicrs. The
firft compliment given me after
entering the cabin, by captain
Whitby, was, “ You damned

returned him onboard the Nan

paid off, Whitby demanded of
them if they would enter ! They
answered no. His answer was,

by all American captains, that
are boarded by this brutish ty
rant, that they receive treat
ment similar to this. It is a
pleating event that he is appoint
ed td\he command of a 74 gun

Giving a deferipdon of this
Whi’.by, will not be a mils, as
those that condjudl themselves
in this manner, generally keep
their names and the names of
their ships a secret, that an A
merican may not know them,
to give any information to the
world of their conduct. This

his right eye, having loft the
