During the week this Troupe has been per

tage. Since it has been opened we have been
visited by the two best shows that have over
'been in the city.
CONGRESS.
Nothing of importance has been done in
'Congress since our last w-site. Most of the time
in both branches has been consumed in dis
cussing the vexed Kansas question. We shall
look with great interest to the result. The
latest Washington news will be found in the

the commonest acts of legislation, it the one

Constitutions of the old States w ere made by '
convention* without ratification, except that of
Massachusetts. The <'-institution of the I ni- 1
ted States was ratified by State conventions,
and never by the popular vote. The amend
ment* to it are to be couenrred iu by State
legislatures, and not by the popular vote, to
give them validity. If Gov. Walker's doctrine
isCorreoL we should be without State Consti
tutions or laws in half ot the States in the
Union. The oltjcetion that att enabling act is
necessary is also answered, nnd shown to be
untenable, both iu principle and authority.
The question relative to the registry and ap
portiownent is very fully treated. Tits charge
that nineteen enmities were disiTaiiehisad is
••umpletely answecivl. There are but thirty
four organized counties In Kansas —twentv-oue
of these were represented, Nineot the thir
teen unrepresented counties Imve very little
population ; in seven of them not a vote was
cast st the January election against the Con
stitution. In two others of tlu- nine, less than
one hundred votes were throw It: and in the
four remaining, nanielr; Franklin, Anderson,
Cotfee. and Breckinridge, the-e were but elev
en and thirty-five. In these four counties the
officers were prevented from making a regis
try.
The report, also sliotvs. from the registry and
apportionment, together with the otticial re
turns, fltat at the 4th of January election the
five counties of Leavenworth, AtchinxHi, Doug
las. Doniphan, and Jefferson, cast five thou
sand one hundred and eighteen votes, which
is a majority ofthe whole vote cast through
out the Territory against the Constitution—
and yet all these counties were registered and
represented in the Convention. Laving thirty -
six of the sixty delegate' of which the Conven
tion was composed. If it l>e true that the op
ponents of the Constitution were so largely in
the majority in those counties, ami so violent
in their opposition, why did they not elect
men to form a Constitution more totheir liking ?
They had within four rates of two-thirds of
the Convention, nhy, then, did they fail to
act *t fhf proper time ? Their refusal, ihctc-
fbre, did not invalidate the just, fair and legal
action of the Convention.
I he resolution under which the committee
was appointed directed them to enquire wheth
er the Lecompton Constitution is acceptable
and satisfactory to the people t The reply to
this is, that the only correct test is the bnilot
, box, and such an expression of the popular
will as is there given at the proper time uud
place, according to Ihw. By this test the Con
stitution was adopted by an overwhelming ma
jority of those who joined in the election.
These only inn be considered as the bona tide
citizens of Kansas. Others, who abstained,
arc mitla tMo residents, who went to Kansas
for mischief and strife. They are self acknow
ledged outlaws, and are not to tie considered
as constituent elements of the community or so
j eiety against which they iu v in open rebellion.
But. on the 4th of January, at the election for
State officers under the Constitution, more
than twelve thousand voters in Kansas did go
to the polls, and thus showed condusivelv that
nt least four-httlis of the voters of that Terri
tory were willing to vote for the election of
State officers under the Constitution. This
shows that the Constitution was not only ac
ceptable, hut. that it has been accepted by at
least tourdittbs of the voters ot that Territory,
though not entirely satisfactory to all of them.
The committee declined to go into an inves
tigation of the alleged fronds at the January
election for State officers for want of jurisdic
tion of the House over the subject. They say
they can no more investigation frauds relating
to the election of State officers in Kansas than
in any other State. Those matters are to be
inquired into by other appropriate legitimate
tribunals. If the seat of the menilier of Con
gress elected to this House be contested on the
ground of alleged frauds, the House would
have jurisdiction over that (piestion : but not
as to frnud< in the election of Governor or
members of the legislature of Kansas,
'I he report ciuirhides with a recommenda
tion for the admission of the State of Kansas,
in pursuance of the views of the President, be
lieving that the welfare and prosperity of the
people <>f Kansas as well a* the gvnelAl wel
fare, peace and harmony of the whole Uuioft,
will thereby be promoted.
