W E. the Jury, find and decree, that the Monroe Hail
Road from Macon to its terminus at Marthasrille, in
the -county of DeKalb, both the part thereof whigh has been
completed and in operation, and the part thereof which is
in an unfinished condition, and all the ptoperty, equipments,
and effects therewith connected, ia subject to the payment
of the debu of the Monroe Hail Hoad and Hanking Compa
ny—that the said Company ia insolvent and wholly unable
to pay its debts aforesaid ; and from its embarrassments is
unable to complete said Hoad, and keep the game in opeia-
tion. so as u> answer the great public objects contemplated
by the Legialature. We find that there are creditors of va
rious description of said company, vii: holders of the l ank
notes issued by said Company, holders of bonds issued fur
work and materials for said Road, judgment creditors,
creditors holding certificates ofdepotite. demands for work!
labor and materials forsaid Kail Hoad, and creditors claim
ing to be mortgage creditors of said Company, and ell other
creditors not lie re enumerated; and that there afe among
them creditors claiming a priority of right in respect to their
demands; and we further decree that the said Hail Hoad,
and all the property, equipments and effects therewith con-
nected.and all the properly belonging to said Company, and
all the rights, privileges and franchises in any manner be
longing or appertaining to said Monroe Kail Road and Han
king Company be sold at public sale at the court boose in
the county of Bibb, by David C. Campbell, Abner P. Pow
ers, James A. Nisbet, Samuel H. Hunter, and Thomas Har
deman, commissioners, or a majority of them, on the first
Tuesday in August next, after giving two months public no
tire in llie gazettes of Macini. Gridin and Savannah, and that
the proceeds of aaiJ sale be paid to the Clerk ol this Court,
who is required to deposite the same for safe-keeping on
spscial deposite in the Agency of the Mechanic*' Hank in
the city of Macon, and that public notice be given to the
creditors of said Company tn tile their respective claims, or
a ached olo thereof in the Clerk’* office of this Coon, by the
first Monday in October next; and that the said creditors, if
any controversy ’should arise respecting said claims, then
litigate amoeg themselves. in reaped to all objection! which
would or might have been available against them by said
Company if said sale liad not been made in relation to mat
ter* of set off, and whether they be subject to objectirn on
a-eount of tbeaiaiule of limitation, non-performance of con
tracts. or other cause, embracing the quantum of considera
tion, paid for the claims or any of them, and also that the
liens claimed by the respective creditots be then and there
also investigat'd and adjudicated: and we further decree
that the purchasers of said Kail Hoad succeed to all the ob
ligations of said Company in respect to the completing,
craping and keening the said Roa* in operation, as intend
ed and designed by the act of incorporation, but not to ex
tend to a liability o"l debts contracted prior to said sale; and
that after said said sale, upon demand or notice, the stock
holders in said Company transfer to the purchaser the stick
held by him, her or them in the said Company, or that the
tide r . transferred by said Cumoiisjioners in the same man
ner as is provided by law for the transfer of bank stock
when »»le thereof is made by the Sheriff: and we further
decree, that for the keeping of said Hoad in operation for
the time intervening between the day of the passing of this
Sc ree and the day of sale, the receipts on the said Hoad be
applied, and that if said receipts should not be sufficient for
said purpose, tbit the balance be pail from the proceeds of
the sale aforesaid; and we further decree that William B.
Tirker as trustee in charge nf said lined mid appurtenances
until ihe sale of llie aforesaid property is completed, matte
monthly returns of the amount ol receipts thereon, and file
the same with the Clerk of this Court, and also of account*
rer keeping the same in repair and operation, exhibiting a
spactfta statement in each of thn number and description of
off -era, agents and hands employed thereon, the value of
each per month, and tha quantity,quality and value of ina-

Bv virtue of the above decree, the undersigned will sell
before the court house door in the city of Macun, on the first
Tuesday in Ampul next, at 12 o’clock, M. the whole line of
the Monroe Bail Road from Macon to Marthasville, ill the
county of DeKalb, aad all the property, equipments and ef
fects therewith connected, atm all the property belonging to
said Company, aad all the rights, privileges ar.d franchises
fn any manner belonging or appertaining to said Mor.roe
Rail Road and Banking Companv, embracing not only the
road, but the various depots, work-shops, ware-houses, en
gines, ears, iron", tools, equipments, ami all auJ every thing
appertaining and belonging to said Hold.
Alio the edlire assets belonging to slid Monroe Hail
Road and Banking Company, embracing subscriptions for
stock unpaid, including the subscription of the Slate of
Georgia for •200,000, and all debts, demands, and claims of
• very kind and description, due to or belonging to said
Monroe Hail Hoad and Hanking Company, a full schedule
<<f which may be seen on application to M. L. Gray bill, at
tht office of said Company.-
The length of the Hoad ia 101 milea. the whole of which
ia graded to It* junction with the Westernand Atlantic Hail
Hoad. The superstructure has been completed on the
whole rn»d, except lour and a half miles. The Rnad is in
use to Jonvsborough, eighty miles, and is equipped with five
locomotive engines, three passenger cars, eighteen freight
cars, wheels and axle* for eight other freight ears, and one
Stationary engine. 1 he terms of sale cash, to be paid im
mediately to tne Commissioners; and on failure of the pur
chasers to comply, so much of tit* property as tusy be bid '
off by such defaulting purchasers, will be forthwith resold
at their risk.

Lumpkin, executed his ccriain mortgage, to Nathan B.
Beall, wherein, he among other thing.*, conveyed to * a id
Beall, certain lots of laud to wit: forty-one. forty-two. fifty-
seven. each containing two hundred two and one half
acres, mote or less, and the west half of lot twenty four, con-
mining one hundred one and a fourth acre* in the ninth die-
trict of said county: the better to secure the payment of a
note of hand, given by said Lumpkin to said Beni!, or bear
er for the payment of six thousand seven hundred »nd sev
enty-three dollar.* due one day after dale, thereof, and
which note was dated the tenth January 1842.
Your petitioner further shew*, that afterwards to-wit: ou
the d.iv and year aforesaid, said note and mortgnge wrre
transferred for n valuable consideration, to your petitioner,
bv the said Beall, and that the same h*ve never been paid,
nor any part thereof, to your petitioner, nor any one else le
gally authorized to receive payment.
Wherefore, your petitioner prays a perpetual foreclosure
of said mortgage unless said Lumpkin shall on or before the
next term at this Coutt. pay the amount of principal, inte
rest and co.t due on said note and mortgage.

T will and testament of Joshna Pattishail. deceased,
whose letters testamentary are now here to the Courtshewn,
whereby, Ac., that on the 25th dav of April, it the year
eighteen hundred and thirty nine, John G. Clark made and
delivered to said Joshua pattishali, then in life, twelve cer
tain promissory notes bearing date, the day and year afore
said, by each nf eleven of which notes, tbe said John ti .
promised by die twenty-fiftb day of December, then, next,
to pay tbe said Joshua Pattishali. or bearer. Thirty Dollars,
and if not punctually paid, interest from the date aforesaid,
value received,and by the lust of which noteo. he, the said
John G. Clark, promised by the twenty-fiftb day of Decem
ber, then next, he the said John G. Ciatk promised to pay
said Josuua Pattishali or bearer. Twenty-Four Dollars and
Fifty Four Cents, anti if not punctually paid, interest from
tbe date thereof, value received, all of which notes together
make the sum nf Three Hundred and Fifty Four Dollars
and Fifty Four Cents, besides interest. And afterwards,
to-wit: On the day and year first aforesaid, the said John
G. Clark the better to secure the payment of said twelve
promissory notes, made and then and there sealed and de
livered to said Joshua Pattishali. his certain mortgage deed,
thereby, murtgaging to said Joshua Pattishali, all the east
half of the lot of land situate, ly ing and being in the fifth
district if Houston county aforesaid, and known and distin
guished in said fifth district, by tbe number fifteen, and
containing one hundred and one and a fourth acres of land
more or less! Yet the said John G. Clark did not. in tbe
life lime of said Joshua, pay him said sums of money, dne
by said promissory notes, or either of them, or any part
thereof, nor has he paid the same, or any part thereof, to
your petitioner, since the death of the said Joshua Patishali.
but the same to pay has hitherto neglected and refused, and
still does neglact and refuse; wherefore your petitioner
prays the foreclosure of said mortgage, in tetms of the sta
tute, in such cases, made and provided, and as in duty, ah.
